AN ACT relating to traffic regulations.
Amend KRS 189A.100 to require all law enforcement agencies to administer field sobriety tests at the scene of every motor vehicle accident resulting in serious physical injury or death; require the test to be administered to every driver involved in the accident; prohibit a driver from refusing to submit to a field sobriety test or other test established under KRS 189A.103; amend KRS 189A.105 to provide that if a driver involved in an accident resulting in serious physical injury or death refuses to submit to a test for drugs and alcohol, the driver is to be taken before a judge who shall issue a search warrant or other court order to compel the driver to submit to drug and alcohol testing; amend KRS 189A.103, 189.580, 189.635, and 281A.220 to conform; name the bill the Patty Nickoson Act.
HB 886 - AMENDMENTS
HCS/LM - Delete all mandatory provisions of the bill compelling persons to take a field sobriety test and denying persons the right of refusal, to provide for law enforcement officers to request all drivers involved in a motor vehicle accident resulting in serious physical injury or death to submit to a field sobriety test; provide that if a driver refuses to submit to a test the driver is subject to administrative suspension of his driver's license under KRS Chapter 189A.
