AN ACT relating to crimes and punishments.
Create new sections of KRS Chapter 197 to deny a convicted sex offender furlough, other type of community release, good time, or other administrative lessening of sentence; create a new section of KRS 197.400 to 197.440 to require all imprisoned sex offenders to participate in treatment; create a new section of KRS Chapter 439 to deny sex offenders shock probation, parole who may have served 85% of sentence, conditional release, or other form of early release from the penitentiary; create a new section of KRS Chapter 533 to deny a convicted sex offender probation, shock probation, conditional discharge, home incarceration, suspended sentence, or other form of avoidance of a sentence of incarceration; create a new section of KRS Chapter 17 to require community notification of the presence of a sex offender; create various sections of KRS Chapter 202A to provide for the civil commitment of sexual offenders; permit the Attorney General to initiate the civil commitment process immediately after the sex offender is released from prison; amend KRS 431.520 relating to pretrial release conditions to include protection of victim; amend KRS 438.250 relating to HIV testing to include crime victims; create a new section of KRS Chapter 439 to require enhanced monitoring of sex offenders while on parole; establish a civil commitment procedure; permit a sexual offender to challenge the civil commitment once a year; create a noncodified section which establishes a notification advisory council to advise the Attorney General on the promulgation of regulations which will govern community notification of the presence of a sex offender; amend various KRS sections to conform.
