     AN ACT relating to tobacco products.
     Amend KRS 438.311 relating to purchase of tobacco products by minors to move jurisdiction from the Department of Agriculture to Juvenile Session of District Court as a status offense; amend KRS 438.313 and KRS 438.325 as they relate to purchase of tobacco products by minors to move jurisdiction from the Department of Agriculture to Juvenile Session of District Court; amend KRS 438.335 relating to disposition of fines and jurisdiction of the Department of Agriculture to conform.

     HFA (3, T. Riner) - Create a new section of KRS 438.305 to 438.340 to prohibit possession of tobacco products, cigars, and cigarettes by persons under 18; exempt persons possessing same in the presence of parent, guardian, or spouse, or who incidentally possess during course of employment but do not use tobacco products; provide that the sentence for violators be not more than 8 hours of community service, all or part of which community service may be remitted if the juvenile tells where he got the tobacco products; provide that all peace officers with general law enforcement authority may issue uniform citations for the the violation of law.
     HFA (4, T. Riner) - Create a new section of KRS Chapter 438 to prohibit persons not already prohibited by law from furnishing cigarettes and tobacco products to minors, to sell or give tobacco products to a minor.
