SB 167 (BR 1569) - K. Nelson

     AN ACT relating to motor carriers.
     Amend KRS 281.624, relating to a certificate to operate as a household goods carrier, to bring the definition of a household goods carrier into compliance with changes made in the federal definition; amend KRS 281.990, relating to penalties for motor carriers, to increase the penalty for operating as a motor carrier without a certificate from a fine of no less than $60 and no more than $200 to no less than $2,000 and no more than $3,500; increase the penalty for hiring a person who does not have a motor carrier permit from a fine of no less than $60 and no more than $200 to no less than $1,000 and no more than $1,500; and create a penalty for operating a motor carrier in violation of the certificate to a fine of not less than $200 and no more than $500; amend KRS 281.631, relating to tacking of certificates at common points to render through service, KRS 281.680, relating to filing and public inspection of rate and service schedules, KRS 281.685, relating to adherence to rates, fares, charges, and schedules, and KRS 281.690, relating to changes in rates, to conform.

SB 167 - AMENDMENTS


     SCS - Retain original provisions of bill except delete explanation of when a household goods certificate is not necessary.
     HCS - Retain the provisions of the original bill, with the following changes: delete the penalty against a private citizen who hires someone to move his belongings and the person does not have the proper permits to be operating as a household goods carrier; make penalty for a motor carrier operating in violation of his permit uniform with penalty established for a person operating as a motor carrier without a permit.
