AN ACT relating to highways and declaring an emergency.
Amend KRS 176.050, relating to duties of the Department of Highways, to require the design plans for all road projects constructing a new route to identify, if at all feasible, one or more sites to be used as waste sites during the construction phase of the project that have the potential to be converted into industrial parks; require the department to consult with local officials on their preferences for the location of potential industrial parks; create a new section of KRS Chapter 176, relating to the Department of Highways, to permit a city, county, or other governmental agency to donate land to be used for industrial park sites; provide for the sites identified to be used for waste during the construction phase to reduce the cost of the construction project and to level or otherwise create a site sufficient to support industrial activities; prohibit hazardous material or hazardous waste from being used as fill material in the waste site; EMERGENCY.
SB 211 - AMENDMENTS
SCS/FN - Retain the provisions of the original bill with the following changes: amend Sections 1 and 2 to clarify that waste sites must be located on land owned by the state, a city, a county, or a government agency; amend Section 3 to clarify that waste includes non-hazardous nonsoluble construction material, steel, concrete, brick, and asphalt, but shall not include vegetation resulting from land clearing and grubbing, utility line maintenance, or seasonal and storm related cleanup; require the waste sites to be compacted and fully prepared for building of an industrial park to begin; require if a waste site is owned by the state, the state must deed the site in fee simple to a city, county, or other government agency when the road construction project is completed.
