SB 26 (BR 932) - J. Pendleton, W. Blevins, T. Buford, B. Jackson, D. Seum, E. Tori
AN ACT relating to state employees.
Amend KRS 18A.140 and 151B.090 to provide classified employees protection from threats dealing with loss of employment, denial of promotion, or any penalty for supporting or not supporting a political candidate or party; permit classified employees to make voluntary donations of money or services but prohibit solicitation of employees by a candidate, committee, state officer, or state employee; provide that no classified employee can participate in political campaign activity during normal state work hours; amend KRS 18A.990 to set the penalty as a Class B misdemeanor.
SB 26 - AMENDMENTS
HCS - Set out those activities which are permitted and prohibited for employees covered under the provisions of KRS Chapters 18A and 151B; establish penalties for violations by persons, officers, and employees; amend KRS 18A.110 to allow the pay plan for classified employees to authorize performance awards to those individual employees who are employed by federal programs which offer performance incentives; amend KRS 18A.405 to establish the Personnel Pilot Steering Committee within the Department of Personnel and require the Governor to appoint its membership according to specified requirements; amend KRS 18A.410 to require the Personnel Pilot Steering Committee to issue a final report upon the conclusion of individual pilot programs and to make recommendations based upon pilot program experience to the commissioner of the Department of Personnel; delete the provision which required the committee to report quarterly to the LRC's Interim Joint Committee on Appropriations and Revenue stating the amount of money saved by the pilot programs and how the money was or is to be spent; amend 18A.420 to conform; amend KRS 18A.425 to require agencies participating in the pilot programs to submit semi-annual reports to the Personnel Pilot Steering Committee; require the Personnel Pilot Steering Committee to submit a comprehensive report to the commissioner of the Department of Personnel and the Governor at least sixty (60) days prior to each Regular Session; amend KRS 18A.430 to require pilot personnel programs to expire no later than three (3) years after implementation unless it is extended by statute but limit all pilots to exist no longer than two (2) regular sessions of the General Assembly; require that no personnel pilot program proposed after the effective date of this Act shall become effective until the program has been presented for review before the Interim Joint Committee on State Government; amend KRS 18A.435 to require the Personnel Pilot Steering Committee to consider evidence of support for pilot programs by taking into account surveys performed by a Governmental Services Center; create a new section of KRS 18A to allow the commissioner of Personnel with the approval of the Personnel Pilot Steering Committee to extent portions of pilot programs which were developed and approved for the purpose of maintaining a pool of available applicants for social service programs and the alternative classification and pay system until December 15, 1998; state that pilot programs in effect July 1, 1998 dealing with performance evaluations shall be subject to the provisions of KRS Chapter 18A and may continue until January 1, 2000, at which time the performance evaluation system shall be presented to the General Assembly for consideration for enactment into law.
HFA (1, S. Nunn) - Amend KRS 18A.990 to increase the penalty from a misdemeanor to a jail term of 2 to 5 years and a fine of not less than ($1,000) nor more than ($5,000); create a new chapter of KRS 151B to conform.
HFA (2, C. Geveden) - Allow employees covered under the provisions of 18A and 151B to campaign for or against candidates only in federal partisan elections.
HFA (3, C. Hoffman) - Delete the provision which allows the commissioner of the Department of Personnel to promulgate administrative regulations concerning pilot programs; delete the provisions which establish and set up the Pilot Personnel Steering Committee, assign its duties and reporting requirements; delete the provision which allows the committee to start accepting applications for pilot personnel programs.
HFA (4, H. Anderson) - Allow employees covered under the provisions of KRS 18A to collectively bargain.
HFA (5, H. Anderson) - Provide that if a pilot personnel project on collective bargaining is submitted to the Personnel Pilot Steering Committee for approval by an executive agency that the project shall be approved by the committee and the commissioner of the department; provide that if more than one (1) pilot on collective bargaining is proposed the commissioner of the Department of Personnel shall decide which program to approve.
HFA (6, T. Burch) - Authorize extension of portions of pilot programs developed and approved to maintain a pool of available applicants for social services programs and alternative classification and pay system until June 30, 2000.
