HB 10/LM (BR 113) - S. Nunn, B. Crall, G. Stumbo

     AN ACT relating to the usage of tobacco by minors.
     Create a new of KRS Section Chapter 438 to prohibit the use of tobacco products by persons under the age of 18, and require confiscation of tobacco products by law enforcement officers from those in violation except as provided in KRS 438.311 and 438.330.

HB 10 - AMENDMENTS


     HCS/LM - Retain original provisions of the bill but require law enforcement officers to also destroy confiscated products, permit officer to charge violator with disorderly conduct as per KRS 525.010 if confiscation resisted, require law enforcement officer to issue a citation and notify the court designated worker who shall notify the parents of the violator as per KRS 610.200, for any subsequent offense the violator shall also attend an education or smoking cessation program if available as determined by the court designated worker, and require notice of attendance and completion of program to court designated worker by violator or monetary and community service penalties as per KRS 438.311(2) applied.
     SFA (1, E. Scorsone) - Remove provisions requiring the confiscation of tobacco products by law enforcement officers and remove exclusion of persons exempted by KRS 438.311 and 438.330.
     SFA (2, E. Scorsone) - Provide that tobacco products must be in plain view of the law enforcement officer before they may be confiscated from a person under the age of 18.
