HB 305/FN (BR 1025) - M. Marzian, L. Napier

     AN ACT relating to the provision of health care services in schools.
     Create new sections of KRS Chapter 156 to create position of education school nurse consultant; establish education and licensure requirements; specify duties; authorize Board of Education to promulgate administrative regulations; create position of public health school nurse consultant; establish education and licensure requirements; express intent of eliminating duplication between nurse consultant positions; define "health services" and "school employee"; provide that health services in schools shall be provided by a licensed physician, advanced registered nurse practitioner, or school employee who has been delegated the responsibility to perform the service and who has been trained to do so; prohibit school employee from refusing to provide the health service if the employee has been delegated the responsibility and trained; require copy of protocols and guidelines to be made available to each school and maintained in the school library; require the school district to immediately make necessary arrangements to provide for a student's health services if a school employee has refused to provide them; prohibit cause for disciplinary action from being taken, under certain circumstances, by school administrators, state or local boards of education, or any licensing or certification board or agency as a result of school employee refusal; prohibit section from being construed to deny a student his or her right to attend public school and receive public school services, or to deny, prohibit, or limit the administration of emergency first aid or emergency procedures.

HB 305 - AMENDMENTS


     HCS (1/FN) - Create new sections of KRS Chapter 156 to create the position of education school nurse consultant in the Department of Education, to establish education and licensure requirements and specify duties; amend KRS Chapter 211 to create the position of public health school nurse consultant in the department of public health to assist school nurse consultant; amend KRS Chapter 156 to define “health services” and “school employee”; amend KRS Chapter 156 to require that health care services be provided within the health care professional's current scope of practice by physicians and health practitioners and designated school employees, subject to staffing and protocols; and amend KRS Chapter 156 to establish responsibilities of the school and the school employee to perform health care services.
     HCS (2/FN) - Retain original provisions except delete the establishment of education school nurse consultant and the establishment of the publish health school nurse consultant; require Department of Education and Cabinet for Health Services to develop and distribute protocols and guidelines on the delivery of health services in the school setting; provide that a school employee shall provide a health service if the employee has been delegated the responsibility by a medical professional, has received training, and is approved by the health professional; require that if a school employee does not provide the health service because the employee has not been delegated, trained, or approved to provide the service that there will be no cause for disciplinary action.
     HFA (1/FN, K. Bratcher) - Require public school pupil who takes medication prescribed to control disruptive or assaultive behavior not to attend school on any day medication is not taken as prescribed by physician; require parent or guardian to administer medication or provide medication to school employee to administer in accordance with school protocol.
     HFA (2, T. Feeley) - Amend new section of KRS Chapter 156 to require the education school nurse consultant to develop documentation and recordkeeping protocols on notification to school administrators and parents of the provision of health care services by a school employee.
     HFA (3, K. Bratcher) - Require public school pupils who takes medication prescribed to control disruptive or assaultive behavior not to attend school on any day medication is not taken as prescribed by a physician; require parent or guardian to administer medication or provide medication to school employee to administer in accordance with school protocol.
     HFA (4, B. Colter) - Retain original provisions, except require that a teacher or other school employee not be delegated to perform health services unless he or she has been directed to perform the service by his or her supervisor.
     HFA (5, T. Feeley) - Amend a new section of KRS Chapter 156 to require the Department of Education and the Cabinet for Health Services to develop documentation and recordkeeping protocols on notification to school administrators and parents of the provision of health care services by a school employee.
