     AN ACT relating to emergency medical services.
     Create various sections of KRS 311.652 to 311.658 to create a 15-member Board of Emergency Medial Services; require that board members be appointed by the Governor; require that members serve no more than (3) two (2) year consecutive terms; provide for reimbursement for travel expenses for official duties; reenact various sections of KRS Chapter 211 as sections of KRS Chapter 311 to define "board," "emergency medical services personnel," "emergency medical services system," "emergency medical technician (EMT)," and "paramedic"; authorize the board to exercise all administrative functions in the regulation of emergency medical services system and the practice of paramedics, emergency medical technicians, first responders, dispatchers, ambulance services, and training institutions; transfer all unexpended funds under the control of the Cabinet for Health Services and the Kentucky Board of Medical Licensure which were derived from fees collected for certification of emergency medical services personnel; authorize the board to promulgate administrative regulations to carry out the functions of the board; permit the board to disburse matching funds to local units of government up to fifty thousand dollars for purchasing ambulances and providing salaries and education for personnel; require emergency medical technicians to complete the requirements of the National Registry of Emergency Medical Technicians for initial licensure; require emergency medical technicians to complete sixteen hours of required topics and eight hours of elective topics or complete requirements of the National Registry of Emergency Medical Technicians; permit the board to set fees for examinations, licenses, and renewal of licenses; amend KRS 205.6314 to require reimbursement rates for services provided by the emergency medical services system to be at least equal to Medicare reimbursement; amend KRS 216B.410 to require ambulance providers or medical first response providers to complete an annual report to the board in lieu of sending run report forms to the Cabinet for Health Services and provide for confidentiality of data; amend KRS 281.014 and 281.605 to conform; amend KRS 304.17A-580 to require all health benefit plans to cover emergency medical services and supplies and to reimburse for supplies used during prehospital care independent of transport; amend KRS 304.39-080 to require motor vehicle insurance to coverage emergency medical services and supplies; amend KRS 311.550 to exempt the performance of duties by paramedics from the definition of "practice of medicine or osteopathy"; amend KRS 311.652 to prohibit anyone from using the term "paramedic" without a valid license; amend KRS 311.654 to require relicensure programs for paramedics to include continuing education and in-service approved by the board; amend KRS 311.656 to conform; amend KRS 311.658 to permit paramedics and emergency medical technicians to function in emergency and nonemergency out-of-hospital situations as approved by the board; amend KRS 311.660 to require any paramedic relicensed within three years of July 15, 1998, to complete in-service training relating to the determination of death and preservation of evidence; amend KRS 311.990 to conform; repeal 211.9533, 211.9535, 211.956, 211.960, and. 311.650; repeal KRS 211.950, 211.952, 211.953, 211.9531, 211.954, 211.962, 211.964, 211.966, 211.967, 211.968 and reenact as a new section of KRS 311.652 to 311.658; and appropriate eight million six hundred ten thousand ninety dollars ($8,610,090) for the fiscal year 2001 and eight million two hundred eighty thousand ninety four dollars ($8,280,094) for the fiscal year 2002 to fund the functions of the Kentucky Board of Emergency Medical Services and provide grants to local units of government for emergency medical services.

HB 405 - AMENDMENTS


     HCS (1/FN/HM) - Retain original provisions; amend various sections of KRS 311.652 to 311.658 to change the composition of the Kentucky Board of Emergency Medical Services; require the governor to appoint residents of Kentucky as members of the board in conjunction with recognized state emergency medical services related organizations; increase the length of terms for board members from two (2) to four (4) years and decrease the number of consecutive terms from three (3) to two (2); require the board to elect a chairman by majority vote at its annual meeting; require personnel assigned to regulate a specific classification of certified or licensed prehospital providers to be at a minimum certified at the same level as those being regulated; permit the board to collect fees; permit the board to establish minimum curriculum and standards for emergency medical services training; restore original requirements for promulgation of administrative regulations for issuing a format for the development of regional emergency medical services plans; change reference to prehospital to out-of-hospital; require certification of emergency medical technicians and licensure for paramedics; amend new section of KRS 311.652 to 311.658 to restore the original limit of grants to local units of government to twenty-five thousand dollars ($25,000); reenact KRS 211.962 as a section of KRS 311.652 to 311.658 to prohibit the use of the title of emergency medical technician by a person who does not hold a current valid certification; delete amendments to KRS 205.6314 to require Medicaid reimbursement rates for ambulance services to be at least equal to Medicare reimbursement; amend KRS 304.17A-580 to exclude accident-only, specified disease, hospital indemnity, Medicare supplement, long-term care, disability incomes, or other limited benefit health plans from the requirement to reimburse ambulance providers for supplies and ambulance services; create a new section of subtitle 20 of KRS Chapter 304 to require motor vehicle insurance to reimburse ambulance services for customary and reasonable services and supplies if a prudent lay person would believe that the person to be transported by the ambulance was in need of medical care; delete amendment to KRS 304.39-080; create a new section of KRS 311.652 to 311.658 to establish disciplinary hearings and sanctions for emergency medical services personnel; permit emergency medical technicians and paramedics to perform any procedure in the most recent curriculum of the United States Department of Transportation for their licensure or certification category or any procedure approved by the board at the discretion of the employer; amend KRS 311.656 to permit paramedics to draw blood samples from a criminal defendant upon request of a peace officer and the consent of the defendant or upon a court order and to require paramedics to be supervised by a physician; amend KRS 311.654 to clarify that the board is referring to the Kentucky Board of Emergency Medical Services; make technical changes; and decrease the appropriation from eight million six hundred ten thousand ninety dollars ($8,610,090) for the 2000-2001 fiscal year and eight million two hundred eighty thousand ninety-four dollars ($8,280,094) for the 2001-2002 fiscal year to four million four hundred ten thousand dollars ($4,410,000) for each of these fiscal years.
     HCS (2/FN/HM) - Retain provisions of HCS; define "medical director"; add 3 members to the Kentucky Board of Emergency Medical Services, two physicians and one trauma surgeon; decrease appropriation to $2,650,000 for each year of the biennium; provide an implementation schedule; make technical corrections.
     HFA (1, J. Vincent) - Retain original provisions; amend to delete language relating to motor vehicle accident insurance and licensed ambulance services.
     HFA (2, J. Vincent) - Retain original provisions; amend to delete language relating to motor vehicle accident insurance and licensed ambulance services; and add language to include licensed ambulance services to the definition of "medical expense."

     SCS/HM - Retain original provisions; require continuing education for paramedics to complete an educational course on human immunodeficiency virus and acquired immunodeficiency syndrome as approved by the Cabinet for Health Services; delete appropriation; make technical corrections.
