     AN ACT relating to Medicaid.
     Create a new section of KRS Chapter 205.510 to 205.645 to require the Cabinet for Health Services to include provisions in all Medicaid managed-care contracts that improve access to culturally competent health care for medical assistance recipients; amend KRS 205.510 to define "culturally competent care".

HB 762 - AMENDMENTS


     HCS/FN - Retain original provisions; amend to require the Cabinet for Health Services to include nondiscrimination standards for Medicaid providers and contractors in all Medicaid contracts instead of provisions for culturally competent care; require Medicaid contractors to develop written policies regarding nondiscrimination in the provision of culturally appropriate care; require Medicaid contractors to develop provider networks to accommodate the racial and ethnic composition of enrollees; prohibit Medicaid contractors from knowingly executing a subcontract with the intent of allowing the subcontractors to discriminate, permit Medicaid contracts to be terminated for noncompliance with nondiscriminatory standards; require any data on enrollment, access, and utilization of services based on minority, racial, or ethnic group to be reported to the Legislative Research Commission prior to September 1, 2001, and annually thereafter; and amend KRS 205.510 to define "nondiscrimination standards for Medicaid providers and contractors" and delete the definition of "culturally competent care."
     HFA (1, P. Bather) - Retain original provisions; amend the new section of KRS 205.510 to 205.645 to add gender to the categories for which nondiscrimination standards for Medicaid providers and contractors apply; require Medicaid contractors and subcontractors to develop written policy statements governing nondiscrimination in the provision of culturally appropriate care; require the Department for Medicaid Services to monitor and enforce adherence of Medicaid providers and contractors to nondiscrimination standards; and delete language regarding the submission of grievances by Medicaid recipients and termination of Medicaid contracts due to noncompliance with nondiscrimination standards; and amend KRS 205.510 to define "nondiscrimination standards for Medicaid providers and contractors" to include equitable access and consideration for covered services regardless of geographic location.
