HB 1/FN/LM/CI (BR 38) - J. Richards, L. Belcher, M. Denham

     AN ACT relating to crimes and punishments.
     Create new sections of KRS Chapter 508 to create the crimes of terroristic threatening in the first degree and terroristic threatening in the second degree and to describe the elements of and penalties for those crimes; amend KRS 508.080 relating to terroristic threatening to conform and to redescribe the crime as terroristic threatening in the third degree; create new sections of KRS Chapter 527 to create the crimes of use of a weapon of mass destruction in the first, second, and third degree and to describe the elements of and penalties for those crimes; amend KRS 500.080 relating to definitions for the Kentucky Penal Code to define a weapon of mass destruction as a destructive device as defined in KRS 237.030 or a chemical, biological or radiological weapon capable of causing death or serious physical injury; amend KRS 532.025 relating to aggravating circumstances in death penalty cases to include use of a weapon of mass destruction.

HB 1 - AMENDMENTS


     SFA (1, A. Robinson) - Add a new Section amending subsection (2) of KRS 503.050 to clarify that the crimes of burglary and robbery, and to specify that sodomy compelled by force or threat, are all to be included as situations where the use of deadly physical force for self protection is justified; amend subsection (2) of KRS 503.070 to reflect the same justification for the use of deadly physical force upon another person.
     SFA (2, A. Robinson) - Add a Section 9 amending KRS 237.110 to require the State Police or the Administrative Office of the Courts to conduct an FBI National Instant Criminal Background Check before issuing a conceal carry license; and to amend subsections (13) and (14) of KRS 237.110 to allow licensees to carry ammunition in particular locations where they may already carry a concealed weapon.
     SFA (3, J. Denton) - Create a new section of KRS Chapter 527 to prohibit possession of a firearm by a person subject to a domestic violence order and prohibit retroactive application.
     SFA (4, R. Roeding) - Amend to include section amending KRS 507.010 to include unborn child within the definition of person for purposes of the criminal homicide statutes.
