HB 34/LM (BR 265) - A. Arnold, K. Hall, F. Nesler

     AN ACT relating to elections and making an appropriation therefor.
     Amend KRS 117.045 to increase precinct election officer pay from minimum of $60 to $100 per election day served, provide a $10 flat fee for delivery of election packets to the polls by election officers and provide a $10 flat fee for delivering election returns by the precinct election judges; amend KRS 117.105 to require counties that used lever voting machines in the 2000 general election to replace those machines with voting systems conforming to the requirements of KRS Chapter 117 not later than the 2004 primary; permit fiscal courts to use General Assembly appropriations, state or federal grants, or other funding in order to transition from lever voting machines; require coordination of transition, and reporting to the State Board of Elections; amend KRS 117.187 to require the State Board of Elections to provide special training regarding election laws after each regular session of the General Assembly, and to increase minimum training compensation for election officers from $10 to $25; amend KRS 117.345 to increase state share of payments for elections from $255 per precinct to $700 per precinct; prohibit payment to a county that has not converted its lever voting machines to voting machines conforming to the requirements of KRS Chapter 117 not later than the 2004 primary; amend KRS 117.375, 117.383, 118.015, 118A.010, 119.005, and 120.005 to delete references to voting punch devices and lever machines; appropriate $954,000 in FY 2002-2003 for transition from lever machines to other voting equipment, and appropriate $2,688,800 in FY 2002-2003, and $2,688,800 in FY 2003-2004 for increase in state share of payments for elections; and provide special effective date of May 1, 2004 for deletion of references to voting punch devices and lever machines.

HB 34 - AMENDMENTS


     HCS/LM - Provide that counties may increase pay and reimbursement for training expenses provided that adequate state funding is available; provide that state share of reimbursement for elections may be increased if adequate state funding is available; provide that transition from lever to electronic voting machines is subject to the discretion of the county fiscal court and contingent on the availability of adequate funds; remove mandatory transition from lever machines to electronic voting machines by 2004 primary; remove appropriations.
