HB 511 (BR 1292) - R. Meeks, De. Butler, J. Jenkins, F. Nesler

     AN ACT relating to alcoholic beverages.
     Amend KRS 241.060 to require a licensee to submit to and pay the costs of food audits if the department reasonably believes that the required percentage of food sales is not being met; require the licensee to undergo mandatory training in lieu of suspension and revocation if the department believes the violations are due to the licensee's lack of knowledge and that training will resolve the problem; amend KRS 243.033 relating to caterer's licenses; amend KRS 243.230 to clarify that soft drinks and candy are not included as staple goods; amend 243.270 relating to special private club licenses; amend KRS 243.360 to require an applicant for a hotel-in-room license to advertise by publication; amend KRS 243.380 to permit an applicant to pay by methods other than cash, check, and money order if acceptable to the board; amend KRS 243.480 to allow training in lieu of part or all of the days of any suspension; require that the content of the training and the number of hours required be established in administrative regulations; set out minimum content for training; amend KRS 244.090 to require that no one under the age of 20 be employed by a licensee in any establishment if employed in any capacity involving the sale, solicitation, and serving of alcoholic beverages by the drink; amend KRS 244.290 to clarify that Sunday sales do not apply to package liquor stores; amend KRS 244.480 to prohibit the sale, delivery, consumption, or giving away of malt beverages on Sundays and at other off times unless the licensee provides a separate compartment in which all stocks of malt beverages are kept during the off time or the legislative body of the city or county has otherwise established the hours and times in which alcoholic beverages may be sold.

HB 511 - AMENDMENTS


     HCS - Retain original provisions; delete requirement that licensee whose license is conditioned on selling a certain percentage of food submit to food audits if the department reasonably believes that the minimum percentage of food is not being sold and replace with language allowing the department to obtain additional documentation of food and alcohol sales; delete the requirement that a caterer's alcoholic beverage stock be kept at a location approved by the state administrator; delete language setting out the minimum content of the training provided licensees; delete requirement that establishes as conditions for the Sunday sale of malt beverages that malt beverages be stored, when not available for sale, in a separate locked compartment and that the legislative body of the affected city or county has so voted; add language creating a fifteen minute period beyond closing time where distilled spirits and wines and malt beverages sold before closing may be consumed.

     HFA (1, T. Riner) - Encourage state owned facilities to implement policies banning the sale of alcoholic beverages at sporting events that are likely to have children in attendance.

     HFA (2, T. Riner) - Encourage state-owned facilities to implement policies banning the sale of alcoholic beverages at sporting events that are likely to have children in attendance.

     SCS - Retain original provisions; delete the provision encouraging state-owned facilities to implement policies banning the sale of alcoholic beverages at sporting events that are likely to have children in attendance.

     SFA (1, J. Pendleton) - Permit a holder of a retail drink license or a retail package license to transport distilled spirits and wine from the premises of a licensed wholesaler to the licensed premises of the retail licensee; permit a retail drink licensee to allow customers to sample distilled spirits and wine on the licensed premises in limited amounts; authorize the issuance of a golf cart supplemental license; allow a caterer licensee to serve distilled spirits and wine at locations for which retail malt beverage licenses have been issued to nonprofit organizations on a restricted basis; authorize the issuance of a distilled spirits and wine temporary license or a special temporary license to a nonprofit organization holding a retail malt beverage license.
