HB 545/FN (BR 1370) - J. Jenkins, C. Geveden, C. Hoffman, D. Horlander, M. Marzian, R. Meeks, C. Miller

     AN ACT relating to workplace violence.
     Create a new section of KRS Chapter 18A to define "workplace violence"; require that state employees receive no less than four hours of training in workplace violence prevention and awareness; specify components of workplace violence prevention and awareness training; require state agencies to complete training by June 30, 2004; amend KRS 18A.030 to require the secretary of the Personnel Cabinet to provide state employees, annually, information on violence in the workplace; create a new section of KRS Chapter 12 to require state agencies to develop, implement and monitor workplace violence programs and specify some elements of a workplace violence safety program; require state agencies to begin implementing a workplace violence safety program no later than January 1, 2003; require the Labor Cabinet on written request to provide information and other technical assistance as needed; create a new section of KRS Chapter 338 to require the Labor Cabinet to recommend to employers that they also implement a workplace violence safety program with the Labor Cabinet providing technical assistance as requested by the employer; amend KRS 338.041 to include workplace violence as a topic for study and demonstration relating to occupational safety and health by the Department of Workplace Standards; create a new section of Subtitle 20 of KRS Chapter 304 to require companies selling casualty insurance to give employers a discount when they have implemented effective workplace violence safety programs; require discount provisions to apply to all policies issued on or renewed after July 1, 2003; create a new section of KRS 15.315 to 15.510 to require the Kentucky Law Enforcement Council, in conjunction with the Labor Cabinet and the Governmental Services Center, to develop a training program of no less than three hours to be offered by the Department of Criminal Justice Training to law enforcement officers and as part of their continuing education and in-service training; create a new section of KRS Chapter 12 to create the Workplace Violence Oversight and Advisory Council; create a new section of KRS Chapter 411 to permit an employer to seek a restraining order on behalf of an employee who has been subject to an act of workplace violence; amend KRS 11.400 and KRS 12.023 to conform.

HB 545 - AMENDMENTS


     HCS/FN - Retain the original provisions except require only three and one-half (3.5) hours of training; make it permissive for companies selling casualty insurance to give employer discounts to those employers who implement an effective workplace violence awareness and prevention program; remove the requirement that would permit an employer to seek a restraining order on behalf of an employee who has been subject to an act of workplace violence; make conforming amendments.

     HCA (1, J. Jenkins) - Retain original provisions, except that the minimum training time for state employees shall be one (1) hour instead of 3.5 hours, and the minimum training time for law enforcement officers provided through the Department of Criminal Justice Training shall be one (1) hour instead of three (3) hours; require the secretary of the Department of Personnel to make an annual report to the Workplace Violence Oversight and Advisory Council, by July 1, on the training provided to state employees during the previous fiscal year; permit the secretary to include training program assessment information and recommendations for future training programs on workplace violence.

     HFA (1, J. Wayne) - Remove the appointment of a member of a mental health profession from the Workplace Violence Oversight and Advisory Council and replace that member with a representative of the Kentucky Employees Assistance Program; specify that state agencies, with the assistance of the Kentucky Employees Assistance Program, be required to develop, implement, and monitor a program designed to reduce or eliminate the risks of workplace violence.
