AN ACT relating to organ donation.
     Create a new section of KRS 311.165 to 311.235 to provide that, as of July 15, 2003, each adult resident of Kentucky will be presumed to have given consent to be a donor of a transplantable organ unless the adult has executed a declaration of nondonation; provide for methods in indicate nondonation by informing doctor or hospital and by informing circuit clerk for indication on a driver's license or nondriver's identification card; provide for revocation of nondonation; exempt health care provider from liability for allowing donation in good faith belief that the person has not executed a declaration of nondonation; amend KRS 311.165 to change definition of transplantable organ; amend 311.171 to prohibit a person from interfering with the donation of a transplantable organ; amend KRS 311.215 to provide that revocation of an anatomical gift does not constitute a declaration of nondonation; amend KRS 311.241 to require hospitals to establish procedures for prompt notification of the organ procurement organization and prompt determination of whether a person has executed a declaration of nondonation; amend KRS 311.245 to require hospitals to convey the intent of a patient to execute a declaration of nondonation; amend KRS 311.990 to establish penalties; amend KRS 186.531 to create the declaration of nondonation form to be used by the circuit clerk if the person wishes to execute the form; provide for entry into statewide electronic database, if created, an on reverse of driver's license or nondriver's identification card; create a new section of KRS Chapter 186 to require the Transportation Cabinet to work with other state agencies to develop educational campaign about the new organ donor law.
