SB 2/FN (BR 1321) - D. Kelly, C. Borders, D. Seum
AN ACT relating to planning for tobacco and substance abuse prevention and services to individuals with mental illness, alcohol and other drug disorders, and dual diagnoses.
Amend KRS 12.330 to increase membership of Kentucky Agency for Substance Abuse Policy and provide for persons representing the same organizations with membership on the Commission on Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Abuse Disorders, and Dual Diagnoses, to be the same person; amend KRS 12.332 to require coordination of KY-ASAP with Kentucky Commission on Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Abuse Disorders, and Dual Diagnoses and require performance-based reporting system by October 1, 2002; amend KRS 12.334 to clarify that KY-ASAP will work with existing local organizations to the fullest extent possible and that local boards shall work with regional mental health and mental retardation boards and regional planning councils; amend KRS 210.502 to add specified persons to the Kentucky Commission on Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Abuse Disorders, and Dual Diagnoses and specify terms of membership; amend KRS 210.504 to permit establishment of workgroups, clarify duties and include strategies to increase public awareness and reduce stigma associated with mental illness and substance abuse disorders and require two-year workplan for the commission, delete the sunset clause, and clarify that focus of the commission shall be on treatment programs; require coordination with KY-ASAP; amend KRS 210.506 to specify participation from population groups; require councils to address regional barriers, workforce issues, community-based hospitalization, and housing options, and report on the use of flexible funding to the commission; require recommendations each odd-numbered year, and delete the sunset clause; require Cabinet for Health Services to honor requests for information; require performance-based reporting system by October 1, 2002; amend KRS 210.509 to clarify duties of the regional planning councils; require councils to work with KY-ASAP; amend KRS 210.040 to require cabinet to require quality assurance and improvement processes from all providers who receive public funds; and amend KRS 222.211 to require the cabinet to work with KY-ASAP and the Commission on Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Abuse Disorders, and Dual Diagnoses to develop substance abuse and tobacco addition programs.
SB 2 - AMENDMENTS
SCS - Retain original provisions, except add to the Kentucky Agency for Substance Abuse Policy Board one member representing the malt beverage industry, in addition to the member representing the distilled spirits industry, who has knowledge of the industry's efforts regarding underage drinking and prevention of alcohol abuse; require each local advisory and coordination board reporting to KY-ASAP to advise the regional mental health/mental retardation boards and regional planning councils of suggested methods of promoting effective treatment of substance abuse; and provide for public and private hospitals that provide mental health and substance abuse services to be included as members of the regional planning councils created by the regional boards.
HCS/FN - Retain original provisions except specify the focus of the Kentucky Agency for Substance Abuse Policy on education and prevention of substance abuse and tobacco use, add specified members to KY ASAP and require that the person representing an entity on KY ASAP that is also a member of the Commission for Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Disorders, and Dual Diagnoses be the same person; require local ASAP boards and regional planning councils to consult and share recommendations; require all agencies represented on KY ASAP to honor requests for information.
HFA (1, R. Crimm) - Require the Kentucky Commission on Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Abuse Disorders, and Dual Diagnoses to study and make recommendations, no later than November 30, 2002, to the General Assembly regarding the implementation of an advance directive for mental health treatment.

Nunn) - Retain original provisions and add to duties of the commission to recommend changes to improve access to mental health screening, evaluation, and treatment for juveniles and prisoners and report by July 15, 2003; amend KRS 441.105 to require a jailer to submit a report to the Department of Corrections within 24 hours of a prisoner's suicide attempt or suicide and report annually on the working arrangement for mental health screening, evaluation, and treatment of prisoners, and require department to send a copy to the Cabinet for Health Services; amend KRS 441.115 to require the training program for jailers to include mental health screening and suicide prevention; amend KRS 441.055 to require jail standards to include training on mental health screening and suicide prevention and to include working agreements for mental health screening, evaluation, and treatment of prisoners; amend KRS 210.400 to require community mental health-mental retardation boards to implement working agreements with correctional agencies.

Nunn) - Retain original provisions and add to duties of the commission to recommend changes to improve access to mental health screening, evaluation, and treatment for juveniles and prisoners and report by July 15, 2003, and require the Kentucky Jailers' Association to assist with recommendations and send the recommendations to the Jail Standards Commission; amend KRS 441.105 to require monthly reports by jailers on requests for and the provision of mental health services, require a jailer provide notice to the Department of Corrections within 24 hours of a prisoner's apparent suicide attempt or apparent suicide and prohibit release of identifying information in reports to the department; require the Department of Corrections to consolidate information on mental health services and suicides and suicide attempts in jails and report by September 1 each year to the Department for Mental Health-Mental Retardation and to the Kentucky Commission on Mental Illness; amend KRS 441.115 to require the training program for jailers to include mental health screening and suicide prevention; amend KRS 441.055 to require jail standards to include training on mental health screening and suicide prevention and to include working agreements for mental health screening, evaluation, and treatment of prisoners; amend KRS 210.400 to require community mental health-mental retardation boards to implement working agreements with local and regional jails and detention facilities; amend KRS 72.025 to require a copy of the required post-mortem examination report to be sent to the Cabinet for Health Services when a death occurs in a mental hospital or mental institution, and a copy to the Department of Corrections when a death occurs in a jail; provide that if budget memoranda provide duties for the Kentucky Commission on Mental Illness relating to mental health services in jails, those provisions shall take precedence.
