     AN ACT relating to sexual offenses.
     Amend KRS 510.060 to define rape in the third degree to include a person 21 or older who engages in sexual intercourse with another person less than 18 years old and for whom he provides a foster family home as defined in KRS 600.020; amend KRS 510.090 to define sodomy in the third degree to include a person 21 or older who engages in deviate sexual intercourse with another person less than 18 years old and for whom he provides a foster family home as defined in KRS 600.020; amend KRS 510.110 to define sexual abuse in the first degree to include a person 21 or older who subjects another person to sexual contact who is less than 18 and for whom he provides a foster family home as defined in KRS 600.020.

SB 227 - AMENDMENTS


     HCS/LM/CI - Delete amendment to KRS 510.110; amend KRS 510.120 so that a person is guilty of sexual abuse in the second degree when that person, being 21 years old or more, subjects another person to sexual contact who is less than 18 years old and for whom the abuser provides a foster home as defined in KRS 600.020.

     HFA (1, T. Riner) - Retain original provisions; create a new section of KRS Chapter 503 to specify when the use of force may be justified in situations which are less than an assault.

     HFA (2, T. Riner) - Retain original provisions; create a new section of KRS Chapter 503 to specify when the use of force may be justified in situations which are less than an assault.

     HFA (3, T. Riner) - Amend to create a new section of KRS Chapter 510 to require prosecutors to oppose the amendment of a first degree rape or sodomy charge to one of sexual misconduct or other misdemeanor charge.

     HFA (4, T. Riner) - Amend to create a new section of KRS Chapter 510 to require prosecutors to oppose the amendment of a first or second degree rape or sodomy charge to one of sexual misconduct or other misdemeanor charge.

     HFA (5, T. Riner) - Amend to create a new section of KRS Chapter 510 to require prosecutors to oppose the amendment of a rape or sodomy charge of any degree to one of sexual misconduct or other misdemeanor charge.

     HFA (6, T. Riner) - Create a new section of KRS Chapter 510 to prohibit a Commonwealth's attorney from plea bargaining rape in the third degree or sexual abuse in the first degree down to a misdemeanor.

     HFA (7, T. Riner) - Amend to create a new section of KRS Chapter 510 to allow force in self defense involving commission of an offense set out in KRS Chapter 510.

     HFA (8, T. Riner) - Amend to create a new section of KRS Chapter 510 to allow force in self defense involving commission of an offense set out in KRS Chapter 510.

     HFA (9, T. Riner) - Amend to insert self defense provision in each crime in the bill and KRS Chapter 510 not involving force as an element of the offense.

     HFA (10, T. Riner) - Amend to insert self defense provision in each crime in the bill and KRS Chapter 510 not involving force as an element of the offense.

     HFA (11, T. Riner) - Amend to insert self defense provision in each crime in the bill not involving force as an element of the offense.

     HFA (12, T. Riner) - Amend to insert self defense provision in each crime in the bill not involving force as an element of the offense.

     HFA (13, T. Riner) - Amend to create a new section of KRS Chapter 510 requiring prosecutor in case under that chapter to ask the victim whether a legislator, the Attorney General, or the Governor's Office on Domestic Violence and Sexual Abuse may contact the victim to inquire as to the efficiency and justice of the criminal justice system in that victim's case.

     HFA (14, T.
