AN ACT relating to employee benefits, making an appropriation therefor, and declaring an emergency.
Declare the intent of the General Assembly that contracts be amended or additional funds appropriated to reduce out-of-pocket expenses for employees, retirees, and dependents covered under the state group health insurance program; EMERGENCY.
HB 1 - AMENDMENTS
HCS - Delete original provisions; establish findings for amending contracts for the state health group plan for 2005; authorize the Finance Cabinet to negotiate with insurers to implement changes; establish benefits, copays, coinsurance, deductibles, and out-of-pocket limits for three health plans; require provider networks comparable to current networks; set employee amounts for single, parent plus, couple, and family coverage for smoking and nonsmoking employees; allow married employees to cross-reference for family coverage; require the Personnel Cabinet to submit proposed health benefits to the Advisory Committee of State Health Insurance Subscribers prior to issuing a request for proposal; provide an additional cost-of-living increase for retired teachers retroactive to July 1, 2004, and provide a further increase July 1, 2005, over the amount provided by statute; establish the KERS and SPRS employer contribution rates for fiscal years 2004-2005 and 2005-2006; authorize cost-of-living increases for state employees and certified and classified school board employees; provide funds to subsidize family coverage for retirees of the Kentucky Teachers' Retirement System and the Kentucky Retirement Systems; appropriate $95,332,500 from the General Fund to Personnel Cabinet in fiscal year 2004-2005; appropriate $397,677,000 from the General Fund to the Department of Education in fiscal year 2004-2005; appropriate $6,119,200 in fiscal year 2004-2005 and $7,706,900 in fiscal year 2005-2006 from the General Fund to the Kentucky Teachers' Retirement System; appropriate $3,773,000 from the General Fund to the Kentucky Retirement Systems in fiscal year 2004-2005; appropriate $1,467,400 from the General Fund to the Judicial Branch in fiscal year 2004-2005; appropriate $268,500 in fiscal year 2004-2005 and $268,500 in fiscal year 2005-2006 from the General Fund to the Legislative Branch; EMERGENCY.
HCA (1, H. Moberly) - Make technical amendments; clarify coverage, cross-reference, deductible, and out-of-pocket limit provisions in the health plans; appropriate from the General Fund $2,000,000 in fiscal year 2004-2005 to the Personnel Cabinet to provide health insurance premium assistance to quasi-governmental employers in the state health insurance group; reduce appropriation to the Personnel Cabinet by $6,996,600; increase appropriation to the Department of Education by $1,304,700.
HCA (2, S. Nunn) - Direct the secretary of the Personnel Cabinet to provide employee organizations who are represented on the Advisory Committee of State Health Insurance Subscribers information necessary so that the member representing the organization can fulfill his or her responsibilities; direct the secretary of the Personnel Cabinet to, at the discretion of the co-chairs of the Interim Joint Committee on Appropriations and Revenue, either submit a written report to or testify before the Interim Joint Committee on Appropriations and Revenue on the state employee health insurance program for the next plan year prior to the issuance of the requests for proposals.
HCA (3, J. Wayne) - Retain original provisions of the committee substitute; require the Speaker of the House and the President of the Senate to establish the Blue Ribbon Panel on Public Employee Health Benefits; provide for the membership and appointment of the panel members; require the panel to meet by January 15, 2005, and require a report and proposed legislation by April 30, 2005; identify areas for review; allow the employment of consultants if approved by the Legislative Research Commission; provide that the panel will be staffed by the Legislative Research Commission; provide that members shall receive actual travel expenses for attending meetings.
HCA (4/Title, H. Moberly) - Make title amendment.
HFA (1, B. DeWeese) - Retain original provisions of bill; create a Blue Ribbon Panel on Public Employee Health Benefits, and define membership and selection of members.
HFA (2, H. Moberly) - Make technical changes to benefits; provide that the difference in employee contribution rates for smokers and nonsmokers shall not be deemed an unlawful practice in violation of KRS 344.040; appropriate from the General Fund to the Personnel Cabinet $2,000,000 in fiscal year 2004-2005 to assist quasi-governmental employers participating in the state employee health insurance program for the employer cost of increased benefits resulting from this Act; change the appropriation from the General Fund to the Department of Education from $397,677,000 to $403,458,900; designate $4,441,900 to support the Kentucky Teachers' Retirement System contributions for associated salary increases for active members; appropriate $1,467,400 in fiscal year 2005-2006 to the Judicial Branch; prohibit the Personnel Cabinet from entering into any new contracts for coverage of employees in the state health plan from the effective date of this Act through December 31, 2005, notwithstanding KRS 78.530; provide that the benefits described in Section 3 of this Act are subject to the contract with the Commonwealth and the certificates of coverage issued in compliance with KRS Chapter 304.
SCS/LM/AA - Retain original provisions; limit Finance and Administration Cabinet to amending current contracts for 2005 health insurance; define "cost"; amend various sections relating to health benefit plans; require cross-referencing for married employees to include employer dependent subsidy along with the two single contributions; add representative of Kentucky Teachers' Retirement System and Kentucky Retirement Systems to Blue Ribbon Panel; make KERS and SPRS employer contribution rates retroactive; increase Personnel Cabinet appropriation $708,014,100 to include base salary and add $1,271,600 for health benefits improvements, $4,412,000 for cost of living adjustments, $59,489,400 for the base employer share of health insurance and flexible spending benefits, and $591,500 for assistance to quasi-governmental employers and KCTCS with health benefit improvements; increase Department of Education appropriation to include $2,387,759,500 for based education salaries, $304,102,600 for baseline employer contributions for health insurance and flexible spending benefits, and increase appropriation for the added health insurance benefits by $1,286,300; increase appropriation to Kentucky Teachers' Retirement System by $105,000 for the dependent subsidy for insurance for retired teachers; increase the appropriation to the Kentucky Retirement Systems by $789,500 for the dependent subsidy for insurance for retired members; appropriate $239,200 in fiscal year 2004-2005 and $239,200 in fiscal year 2005-2006 to the Judicial Branch for an additional cost of living adjustment January 1, 2005; increase the Legislative Branch appropriations by $54,500 in fiscal year 2004-2005 and $377,500 in fiscal year 2005-2006 for additional health insurance benefits.

SCA (2, R. Sanders Jr) - Amend various provisions within Section 3 of the bill to clarify that member costs for medical services come from the provider network.
