HB 480 (BR 1365) - R. Webb

     AN ACT relating to medical malpractice insurance.
     Create a new section of Subtitle 40 of KRS Chapter 304 to require medical malpractice insurers to develop and establish an experience rating plan, that provides for surcharges and discounts for insureds who implement risk management techniques; subject the plan to disapproval by the commissioner of insurance.

     HCS - Delete original provisions of the Act; direct the Legislative Research Commission to establish the Kentucky Medical Malpractice Insurance Task Force; authorize the task force to meet monthly and employ consultants upon approval of the Legislative Research Commission; direct the task force to study all aspects of the medical malpractice liability insurance matter, including Kentucky's insurance laws and insurance market issues, tort laws, all legislation introduced during the 2005 Session of the Kentucky General Assembly pertaining to the issue, actions taken in other states, and patient safety matters; require the task force to submit its report to the Legislative Research Commission by November 1, 2005.
