SB 25 (BR 317) - J. Denton, W. Blevins Jr, D. Boswell, T. Buford, D. Harper Angel, A. Kerr, J. Rhoads, R. Roeding, R. Sanders Jr
AN ACT relating to organ and tissue donation.
Amend KRS 214.155 to require the Cabinet for Health Services to provide information on the Internet on the availability of comprehensive newborn screening tests related to heritable and genetic congenital disorders; require the cabinet to inform health facilities and health care providers and others that the information is available on the Internet; require health facilities and health care providers to inform an infant's parent or guardian of the availability of these tests and provide for a consent form promulgated administrative regulation by the cabinet; require a health facility to conduct or arrange for additional testing by a qualified laboratory and provide the appropriate follow-up health care; permit the cabinet to enter into agreement with public or private qualified laboratories to perform newborn screening tests; define qualified laboratory; permit health facilities and health care providers to send their samples to any qualified laboratory.
SB 25 - AMENDMENTS
SCS - Delete all original text; insert a new section of KRS Chapter 194A to require the Cabinet for Health Services to establish and maintain a statewide registry for organ and tissue donation and specify it may be funded by state appropriation, grants, or other public or private funds; permit the registry to be maintained by a public or private gatekeeper; require the cabinet to collaborate with specified entities to establish strategies for registry operations; specify the registry meets legal standards for informed consent; specify access to the registry; require evaluation of the effectiveness of the registry; require the cabinet to promulgate administrative regulations.
SCA (1/Title, J. Denton) - Make title amendment.
HCS (1) - Retain original provisions; add section to amend KRS 311.195 to permit a gift of all or part of the body through registration on a statewide organ and tissue donor registry.
HCS (2) - Retain provisions of HCS 1; amend KRS 369.102 to define "authorization" and "electronic identification"; create a new section of KRS 369 to allow electronic signature authentication and identification for transactions relating to identifiable health information and list possible components of a system for authentication and identification of electronic signature; specify that DNA shall not be used as a biometric identifier; add HIPPA provision.
HFA (1, T. Burch) - Clarify that electronic signature verification and authentication may be accomplished by an interactive system of security procedures that includes but is not limited to one or more of the listed procedures; allow an additional security procedure that includes log-on and password as two unique identifiers.
