     AN ACT relating to post secondary education and declaring an emergency.
     Create a new section of KRS Chapter 164, relating to state universities and colleges, to establish legislative intent and set forth goals a new Council on Postsecondary Education is to implement by the year 2020; amend KRS 164.001 to establish definitions to govern KRS Chapter 164; create various new sections of KRS Chapter 164 to create a Strategic Committee on Postsecondary Education; establish membership and duties of the committee; provide for members to serve on the search committee for the initial appointment of the president to the Council on Postsecondary Education; establish procedures to be followed to conduct a search for the president; require the council to employ a search firm and establish job requirements, duties, and salary of the council president; require the Council on Postsecondary Education to adopt a strategic agenda to carry out goals established in Section 2 of the Act; require the council to develop objective measures to judge the implementation of goals and establish criteria for benchmarks; create a strategic investment and incentive program for postsecondary education and establish six individual strategic investment funds within the State Treasury; permit the individual trust funds to receive state appropriations, gifts from public and private sources, and federal funds; establish how unalloted or unencumbered balances in the trust funds are to be invested; require the Council on Postsecondary Education to make biennial budget requests for the Strategic Investment and Incentive Funding Program; establish the research challenge trust fund and application criteria and allocate appropriations between UK and U of L; establish the regional university excellence trust fund and require funds to be apportioned to each of the six regional universities on a proportional basis; establish the technology initiative trust fund and establish how the Council on Postsecondary Education is authorized to use the fund; establish the physical facilities trust fund and establish how the Council on Postsecondary Education is authorized to use the fund; require all capital projects funded under the trust fund to go through the capital review process of KRS Chapters 7A, 45, 45A, and 48; establish the postsecondary workforce development trust fund and establish how the Council on Postsecondary Education is authorized to use the fund to assist community colleges and technical institutions for the acquisition of equipment and technology; establish the student financial aid and advancement trust fund and establish how the Council on Postsecondary Education is authorized to use the fund; create the distance learning advisory committee to advise the Commonwealth Virtual University; establish membership of the advisory committee; mandate the president of the KY Community & Technical College System to appoint 2 chancellors, one to head the community colleges branch and one to head the technical institution's branch, except the first chancellor shall be the present chancellor of the UK Community College System; require that the next appointments of the chancellor for the community colleges' branch be appointed by the president from nominations of a search committee composed of equal members appointed by the UK board of trustees and the KY Community and Technical College System board of regents; establish the chancellors' qualifications and duties; effective 7/1/98 transfer all staff, property, and responsibility of postsecondary institutions in the KY Tech System from the Cabinet for Workforce Development to the KY Community & Technical College System; establish in detail how employees and responsibilities are to be transferred; effective 7/1/98 transfer all staff, property, and responsibilities of the community colleges from UK to the KY Community and Technical College System - with the exception of Lexington Community College, which is to be retained by UK; establish in detail how employees and responsibilities are to be transferred; establish that community college students shall retain rights and privileges provided in the UK Community College System administered by the UK board of trustees; authorize the board of regents for the KY Community and Technical College System to provide medical and accident insurance to students enrolled in the system; require the president on behalf of the board of regents for the KY Community and Technical College System to report biennially during odd-numbered years to the Council on Postsecondary Education on the condition and operation of the system; require the Council on Postsecondary Education to establish regional advisory groups to assist in the development of regional strategies for technical and community college education; authorize the KY Community & Technical College system to purchase necessary services from UK; require the transfer of credit hours to be recognized and accepted in the same manner as they were handled prior to the creation of the KY Community and Technical College System; require the Council on Postsecondary Education to resolve disputes relating to the transfer of credit hours; require the finance cabinet, on or before 8/15/99 and each subsequent odd-numbered year, to provide each branch of government a budget planning report based on information reported by the consensus forecasting group created by KRS 48.115; amend KRS 18A.115 to exempt employees of the Council on Postsecondary Education from the state's classified employment service; refuse to guarantee reemployment rights to employees of the KY Community and Technical College System transferred under this Act; amend KRS 61.525 to include employees of the KY Community and Technical College System under the Kentucky Employees Retirement System; amend KRS 63.080 to prohibit the removal of members of boards of trustees, boards of regents, and the Council on Postsecondary Education without cause; amend KRS 95A.020 to conform, to delete references to the commissioner of the Department for Adult and Technical Education and add the chancellor for the technical branch of the KY Community and Technical College System; delete references to the office of KY Tech System under the Workforce Development Cabinet; add the KY Community and Technical College System; amend KRS 151B.025 to limit the Department for Technical Education within the Cabinet for Workforce Development to responsibility for state-operated secondary area vocational education and technology centers; change KY Board of Education to Education Professional Standards Board; amend KRS 151B.030 to conform, to delete references to the deputy commissioner of the Department for Technical Education as the supervisor of the office of the KY Tech System; change the name of the Division of Federal Programs and Support Services to the Division of Administrative Services; change the name of the Office of the KY Tech System to the Office of Area Vocational Education and Technology Centers; change the name of the Division of School Operations and the Division of Program Management to the Division of School Management and the Division of Curriculum Services respectively; amend KRS 151B.035 to, effective 7/1/98, abolish all positions of employees transferred from the Cabinet for Workforce Development to the KY Community and Technical College System; refuse to guarantee reemployment rights to employees so transferred; amend KRS 151B.075 to change references to KY Tech System to state-operated vocational and area technology centers; amend KRS 151B.095 to delete existing duties of the state board for adult and technical education and permit the board to enter into agreements with the KY Community and Technical College System to provide space and equipment for adults in area technology centers; prohibit the board from operating full-time diploma postsecondary programs unless an agreement has been reached with the KY Community and Technical College System; amend KRS 151B.110 to require the State Board for Adult and Technical Education to be responsible for literacy programs; repeal and reenact as a new section of KRS Chapter 164 and amend KRS 151B.115 to provide for joint programming of vocational-technical education nondegree programs with associate degree programs to be pursued between the KY Community and Technical College System and other postsecondary institutions; amend KRS 151B.165 to require tuition and fees for secondary pupils enrolled in area vocational education and technology centers to be free to KY residents; require the State Board for Adult and Technical Education to fix the rate of tuition for adults enrolled in secondary programs; provide for the Council on Postsecondary Education to fix the rate of tuition of adult students enrolled in full-time postsecondary programs under the control of the KY Tech College System that are physically located in an area vocational education or technology center; amend KRS 151B.175 to change reference from state vocational technical schools to secondary area technology centers; amend KRS 151B.215 to change membership of the KY Occupational Information Coordinating Committee as follows: delete the commissioner of the Department for Technical Education, delete one chancellor from UK, and add two chancellors from the KY Community and Technical College System; amend KRS 151B.410 to delete references to UK in association with the community college system; amend KRS 154.12-205 to change the reference from the chancellor of the UK Community College System to the president of the KY Community and Technical College System; amend KRS 154.47-055 to change the references from the UK Community College System and the KY Tech System to the KY Community and Technical College System; amend KRS 156.740 to add the president of the KY Community and Technical College System to the Interagency Commission on Educational and Job Training Coordination; amend KRS 161.220 to change the references from community or junior colleges established by a university to the KY Community and Technical College System and any community college established under its control for retirement system purposes; amend KRS 164.0053 to permit community and technical college faculty and nonteaching personnel serving on the board of regents for the KY Community and Technical College System to serve on the Council on Postsecondary Education; amend KRS 164.011 to create the Council on Postsecondary Education, members of which shall be the commissioner of education as a nonvoting member and 13 members appointed by the Governor and confirmed by the House and Senate; establish procedures and time frames for nominations and appointments to the council; amend KRS 164.020 to establish the powers, duties, and responsibilities of the Council on Postsecondary Education; amend KRS 164.021 to add the president of the KY Community and Technical College System to the advisory conference for the Council on Postsecondary Education; amend KRS 164.050 to set a per diem fee of $100 per day for members of the Council on Postsecondary Education; amend KRS 164.095 to change reference from UK Community College System to KY Community and Technical College System; amend KRS 164.125 to delete statement that UK is the only institution authorized to expend state general fund appropriations on research and service programs with a statewide nature financed principally by state funds; amend KRS 164.131 to require UK board appointments after the effective date of this Act to complete an orientation program; permit the Governor to remove board members for cause; delete the UK board member representing the teaching faculty of the Community College System; amend KRS 164.260 to reference to KRS 164A.575; amend KRS 164.2891 to permit any postsecondary education institution under the jurisdiction of the Council on Postsecondary Education to have a faculty member as a voting member of its board of trustees or regents; amend KRS 164.310 to establish a board of regents for the KY Community and Technical College System; amend KRS 164.321 to establish procedures for appointing members of the board of regents for the KY Community and Technical College System; amend KRS 164.330 to require expenses of the board of regents for the KY Community and Technical College System to be paid from system funds; amend KRS 164.335 to prohibit members of the General Assembly from serving on the board of trustees or regents of a state-supported technical institution or community college; amend KRS 164.360 to require the board of regents of the KY Community and Technical College System to appoint a president and other officers as needed and fix compensation and terms of employment; amend KRS 164.365 to require the board of regents of the KY Community and Technical College System to develop personnel rules by 6/30/98; amend KRS 164.410 to reference KRS 164A.575; amend KRS 164.580 to establish the KY Community and Technical College System; establish services to be provided for continuing education and customized training; amend KRS 164.591 to permit a community college or an extension of a community college to be located in Paducah; permit UK to keep Lexington community college and WKU to keep the community college in Bowling Green; permit regional universities to offer associate degree programs; require new community colleges to be approved by the General Assembly; amend KRS 164.593 to require the board of regents of the KY Community and Technical College System to recognize previous actions committed pursuant to this section; amend KRS 164.594 to delete reference to UK and insert in lieu thereof the KY Community and Technical College System; amend KRS 164.597 to delete reference to UK and insert in lieu thereof the KY Community and Technical College System; amend KRS 164.600 to create a board of directors for each community college and establish their duties; amend KRS 164.740 to amend definitions governing KRS 164.740 to 164.785 to include institutions of postsecondary education in the definition of "college"; amend the definition of "vocational school" to include technical institutes or technology centers operated by the board of regents for the KY Community and Technical College System; amend KRS 164.821 to require U of L board appointments made after the effective date of this act to complete an orientation program; permit the Governor to remove U of L board members for cause; amend KRS 164.830 to increase the UL executive committee from 5 to 6 members; amend KRS 164A.550 to amend the definitions governing KRS 164A.555 to 164A.630 to include the boards of regents for the KY Community and Technical College System under "governing board"; establish a transition team to oversee the creation of the KY Community and Technical College System; add a severability clause; amend KRS 332.110 to delete the reference to UK Community College System; HB 1 - AMENDMENTS


     HCS (1/LM) - Retain the provisions of the original bill with the following changes: Clarify that the mission of the Kentucky Community and Technical College System is to provide a two-year course of general studies for transfer to a baccalaureate program, to develop workforce skills, and to provide remedial and continuing education which should be carried out in conjunction with other postsecondary institutions; provide that four, rather than two, appointments to the Council on Postsecondary Education expire at the end of 1998; add a full-time faculty member to the Council on Postsecondary Education, to be appointed by the Governor for a four-year term from a list of three nominees submitted by a majority vote of the boards of trustees and the boards of regents; add a student member to the Council on Postsecondary Education, to be appointed annually by the Governor from a list of three nominees submitted by majority vote of the eight student body presidents of the four-year institutions and one representative of the community college student body presidents, elected from among themselves; require that the chair of the Council on Postsecondary Education be elected by the council membership rather than chosen by the Governor; delete the requirement that appointees to the Council on Postsecondary Education and the Kentucky Community and Technical College System Board of Regents sign a statement affirming their understanding of the strategic agenda and the mission of the institutions they represent; require the Council on Postsecondary Education to seek advice from the Department of Education and local school districts to create a smooth and effective transition for elementary and secondary students to postsecondary education; direct the Council on Postsecondary Education to develop a statewide policy to promote employee and faculty development through tuition waivers in state-supported postsecondary institutions; clarify that the proportional political representation of the appointees to the Council on Postsecondary Education be based on voter registration data for the state's two major political parties and to ensure that appointments reflect the minority racial composition of the state; clarify that the president of the Council on Postsecondary Education serves at the pleasure of the council; specify that elections for appointments of faculty members to fill vacancies for an unexpired term on the board for the Kentucky Community and Technical College System be conducted in the same way as the original election; provide that the Kentucky Community and Technical College System board may divide assets transferred from the University of Kentucky among organizations and institutions within the Community College Branch; delete the tuition waiver for full-time faculty in the Technical Institutions' Branch of the Kentucky Community and Technical College System; change the tuition waiver for full-time faculty in the Community Colleges' Branch of the Kentucky Community and Technical Colleges System to defray registration for up to six hours per semester, to allow full-time faculty to take one course per semester during working hours, with administrative approval, and to restrict the option to attend University of Kentucky or University of Kentucky community colleges, rather than any state-supported institution; grant the authority for the use and management of the budget of a community college to the president of the community college rather than to the board of directors; make technical corrections.

     HFA (1, B. Yonts) - Permit organized group in a county to create satellite of a community college, providing they fund it.
     HFA (2/Title, B. Yonts) - Allow any community college that has raised sufficient funds to build the satellite by January 1, 1997, to do so on or after January 1, 1998.
     HFA (3, M. Long) - Create a new section in KRS Chapter 164 to establish an eleven-member Commission on Postsecondary Education Efficiency within sixty days of the adoption of the strategic agenda by the Council on Postsecondary Education; require a review of all programs offered in Kentucky's postsecondary education system, to identify programs to abolish based on low performance or unnecessary duplication; require that findings be reported within six months of its creation to the Council on Postsecondary Education and the Legislative Research Commission; and require that the entire list be adopted, unless a line-item appropriation is provided by the General Assembly at the next regular session.
     HFA (4, H. Collins) - Amend KRS 164.365 to authorize the board of regents for the Kentucky Community and Technical College System to establish a salary schedule for faculty and staff of the system.
     HFA (5, R. Murgatroyd) - Require that the members of the Governor's Higher Education Nominating Committee reflect the 2 leading political parties of the Commonwealth based on the state's voter registration.
     HFA (6, M.      HFA (7, P. Mason) - Require that the first $1 million appropriated to the Student Financial Aid and Advancement Trust Fund be allotted for the purpose of assisting welfare recipients, individuals who have lost welfare benefits, and those with disabilities who do not qualify for vocational rehabilitation services, to obtain employment skills.
     HFA (8, J. Coleman) - Remove the personnel dispute resolution system from the board of regents for the Kentucky Community and Technical College System.
     HFA (9, J. Gray) - Provide that Kentucky Community and Technical College System faculty and other employees have a vested contract right to continued employment and shall be subject to disciplinary personnel actions only upon a showing of just cause and shall be subject to layoff only if necessary, due to a financial emergency, and permit the dismissal of or imposition of other penalty against a KCTCS faculty member or other employee only for incompetence or neglect of or refusal to perform duties.
     HFA (10, T. Riner) - Require one list of nominations and an appointive member to be from community college advisory board.
     HFA (11, T. Riner) - Require one list of nominations and an appointive member to have served on a regional advisory board for the system of postsecondary vocational-technical schools.
     HFA (12, F. Rasche) - Make technical correction.
     HFA (13, L. Brandstetter) - Add new section to amend KRS 11A.010(7) to include the members of the Council on Postsecondary Education in the list of officers who are subject to the provisions of the Executive Branch Code of Ethics.
     HFA (14, B. Crall) - Change name of Kentucky Community and Technical College System to the Kentucky Community College and Technical Institute System; delete language making chancellor of the University of Kentucky Community Colleges chancellor of the newly-created community college system; delete language requiring that rights and privileges of the University of Kentucky students be extended to students at the community colleges and replace with language requiring that the KCCTI System board of regents negotiate with the state universities for such rights and privileges; delete language permitting the University of Kentucky to issue degrees to the community college students and replace with language allowing students at the community college branch to elect to receive a diploma from any state university offering a substantially similar program; add language increasing KCCTI board to include a representative from each state university for purpose of developing joint programs.
     HFA (15, R. Damron) - Limit a standardized degree program to the first sixty (60) hours of a degree or program.
     HFA (16, R. Damron) - Clarify that the Council on Postsecondary Education's biennial budget request is to include capital projects.
     HFA (17, R. Damron) - Exempt Council on Postsecondary Education capital construction projects from the requirements of the prevailing wage law.
     HFA (18, C. Hoffman) - Amend KRS 164.365 to permit the Kentucky Community and Technical College System to deduct membership dues from the employee's paycheck for employee membership organizations.
     HFA (19, J. Barrows) - Delete listing of individual General Assembly's representation on the Strategic Committee on Postsecondary Education, and add the members of the Legislative Research Commission; stipulate that agreement shall be unanimous among the groups of the Strategic Committee on Postsecondary Education.
     HFA (20, T. Riner) - Require one list of nominations and an appointive member to have served as a member of a community college advisory board.
     HFA (21, T. Riner) - Require one list of nominations and an appointive member to have served on a regional advisory board for the system of postsecondary vocational and technical schools.
     HFA (22, J. Lee) - Provide that the Council on Postsecondary Education shall not abolish or limit the total enrollment of the general 2 year course of general studies designed for transfer to a baccalaureate program offered at any community college.
     HFA (23, M. Treesh) - Convert the Strategic Committee on Postsecondary Education into a temporary body which searches for the first president of the Council on Postsecondary Education and then disbands.
     HFA (24, H. Collins) - Amend Section 19, relating to the Kentucky Community and Technical College System (KCTCS) being the legal successor to the University of Kentucky Community College System, to delete subsection (6) in its entirety and insert in lieu thereof a provision authorizing full-time employees of the KCTCS to take a maximum of six (6) credit hours per term at any state-supported postsecondary institution and require the institution to waive tuition fees for those six (6) hours.
     HFA (25, M. Treesh) - Change the name from "The University of Kentucky Community College System Branch" to "The Kentucky Community College Branch."
     HFA (26, T. Riner) - Require the boards of trustees for the University of Kentucky and the University of Louisville and the boards of regents for the regional universities and the Kentucky Community and Technical Colleges System to seek to ensure, when hiring faculty, that all major philosophical viewpoints and perspectives which may exist within each field of study are represented in the collective makeup of the faculty within each field of study.
     HFA (27, F. Rasche) - Establish the right of graduates of a technical program within three (3) years of the program becoming an accredited degree program to receive partial or full credit toward a degree, based on criteria established by the board of regents for the Kentucky Community and Technical College System.
     HFA (28, H. Anderson) - Changes the name "University of Kentucky Community College System Branch" to the "Kentucky Community College Branch." Mandates the removal of all references to the University of Kentucky or the University of Kentucky Community College System from all signs and buildings.
     HFA (29, H. Anderson) - Remove the prohibition upon the Council on Postsecondary Education from eliminating or dis-establishing any college of law.
     HFA (30, J. Callahan) - Make a technical change.
     HFA (31, J. Haydon) - Amend a new section of KRS 164 to provide that regionally accredited private institutions may apply for assistance awards from the Financial Aid and Assistance Trust Fund; and amend KRS 164.785 to restore eligibilty for financial assistance to students in independent private colleges.
     HFA (32, J. Stacy) - Amend KRS 164.020 to require Council on Postsecondary Education to develop a financial reporting system.
     HFA (33, M. Brown) - Provide that notwithstanding the provisions of KRS 11A.040, any person employed by the Council on Higher Education prior to the effective date of this Act may accept immediate employment with any governmental entity or any postsecondary education organization or institution in the Commonwealth.
     HFA (34, S. Baugh) - Amend to attach the secondary area vocational education and technical centers to the KCTC System.
     HFA (35, K. Hogancamp) - Establish a student's right to choose an academic or vocational program of study based on personal interests and academic preferences; assuring that this Act shall not be construed to compel a student toward a particular program of study.
     HFA (36, G. Stumbo) - Allow full-time employees of community colleges to take a maximum of 6 credit hours per semester at any state-supported postsecondary institution.
     HFA (37, H. Anderson) - Amend KRS 164.020 to grant the Council on Postsecondary Education authority to disestablish or convert regional universities into community colleges.
     HFA (38, H. Anderson) - Amend KRS 164.295 to remove authority from the regional universities to provide programs of a community college nature; amend KRS 164.591 to include Bowling Green, Lexington, and Northern Community Colleges in the Kentucky Community and Technical College System; and repeal KRS 164.597 concerning Northern Community College.
     HFA (39, M. Marzian) - Require equal gender representation on the Council on Postsecondary Education and the Governor's Higher Education Nominating Committee; prohibit more than three members, as opposed to two, of the Council on Postsecondary Education or the Kentucky Community and Technical College Board, to reside in the same judicial district.
     HFA (40, K. Hogancamp) - Direct that the General Assembly give prior approval before receipt of private moneys and gifts from any private entity to the Strategic Investment and Incentive Funding Program, or any board, council, or committee involved in the postsecondary education system of Kentucky; approval to be given during a regular or special session; all records of private moneys accepted subject to full public disclosure.
     HFA (41, H. Collins) - Amend Section 19, relating to the Kentucky Community and Technical College System (KCTCS) being the legal successor to the UK Community College System, to add a new subsection (7) to authorize full-time faculty members and staff persons to have tuition-free access to continuing education at the postsecondary institution of their choice; limit the number of hours per term or year to the institution's policy governing internal faculty's access to continuing education on the effective date of this act.
     HFA (42, J. Barrows) - After the enacting clause, delete the second committee substitute to House Bill 1 in its entirety and insert in lieu thereof the following: establish findings of General Assembly and declare future goals for postsecondary education; delete all duties of the Strategic Committee on Postsecondary Education (SCOPE), except to serve as a search committee for the initial appointment to the position of president of the Council on Postsecondary Education; establish duties of the Council on Postsecondary Education, as well as the president of the council; require the Council to adopt a strategic agenda to identify short-term and long-term strategies to achieve the postsecondary goals established by the General Assembly; leave the community college sytem untouched under the authority of the University of Kentucky; elevate the postsecondary education institutions in the Kentucky Tech System to a level equal to a regional university; name the new system the Kentucky Technical College System and establish a board of regents to govern the new system; establish powers and duties of the board of regents of the Kentucky Technical College System; amend numerous KRS sections to conform; repeal KRS 151B.160, 164.575, 164.582, and 186.1865 to conform.
     HFA (43, M. Treesh) - Specify the appointment of citizens, faculty and student memberships; provide the nomination process for the student members, which includes student body presidents and representation of student members to the Kentucky Community and Technical College System; and recalculate the terms of the 13 citizen members.
     HFA (44, G. Stumbo) - Provide that Kentucky Technical College System faculty and other employees have a vested contract right to continued employment, and shall be subject to disciplinary personnel actions only upon a showing of just cause, and shall be subject to layoff only if necessary, due to a financial emergency; permit the dismissal of or imposition of other penalty against a KTCS faculty member or other employee only for incompetence, or neglect of or refusal to perform duties; amend KRS 164.365 to permit the Kentucky Technical College System to deduct membership dues from the employee's paycheck for employee membership organizations, and to authorize the board of regents for the Kentucky Technical College System to establish a salary schedule for faculty and staff of the system.
     HFA (45, J.      HFA (48, K. Hogancamp) - Modify the definition of "adult basic education" to include grammar and spelling as components of language arts.
     HFA (49, K. Hogancamp) - Modify the definition of "adult basic education" to include American history, grammar, and spelling, and clarify its purpose.
     HFA (50, K. Hogancamp) - Modify the definition of "adult basic education" to include the preservation of our representative form of government in the section defining the purpose of such education.
     HFA (51, K. Hogancamp) - Modify definition of "Adult basic education" to include American history as part of social studies.
     HFA (52, H. Anderson) - Amend KRS 164.600 to grant a community college board of directors the option to stay a part of the University of Kentucky Community College System or be independent within the Kentucky Community and Technical College System; the decision to be binding for ten years.
     HFA (53, H.      HFA (54, P. Mason) - Apply a minimum of twenty-five percent (25%) of the fund appropriation toward assistance for individuals whose family income is one-hundred percent (100%) of the federal poverty guidelines or for individuals with disabilities.
     HFA (55, J. Arnold Jr.) - Require the board of regents of the Kentucky Community and Technical College System to promulgate administrative regulations, rather than make rules, regarding employees of the system; and delete the exclusion of rules, regulations, and policies pertaining to the faculty and staff of the postsecondary institutions from the definition of "administrative regulation".
     HFA (56, R. Damron) - Authorize the University of Kentucky as the only institution to expend state general fund appropriations on research and service programs of a statewide nature financed principally with state funds, including research and service programs of a statewide nature requiring the establishment and operation of facilities or centers outside of the primary service area of the institution.
     HFA (57, K. Hogancamp) - Prohibit the board of regents for the Kentucky Community and Technical College System and the Council on Postsecondary Education from establishing rules that would limit the number of students who could enroll in prebaccalaureate transfer programs in community colleges.
     HFA (58, J. Barrows) - Increase membership of the Strategic Committee on Postsecondary Education to include 6, rather than 5, Council on Postsecondary Education members, 7, rather than 6, members appointed by the Governor, a member appointed by the President of the Senate, a member appointed by the Speaker of the House of Representatives, a member appointed by the Minority Floor Leader of the Senate, and a member appointed by the Minority Floor Leader of the House of Representatives; include representatives of technical institutions in those groups who submit nominees to the Governor's Nominating Committee on Postsecondary Education; and clarify that members of boards of regents and trustees shall complete their orientation program as a condition of their service, rather than as a prerequisite to their appointment.
     HFA (59/FN, S.      HFA (60, D. Ford) - Remove the establishment of the regional advisory groups, by the Council on Postsecondary Education, to assist in the development of regional strategies for workforce development.
     HFA (61, M. Marzian) - Require equal gender representation on the Council on Postsecondary Education, the Governor's Higher Education Nominating Committee, and the Kentucky Community and Technical College Board of Regents; prohibit more than three members, as opposed to two, of the Council on Postsecondary Education or the Kentucky Community and Technical College Board, to reside in the same judicial district.
     HFA (62/FN, S. Cave) - Omnibus revision of the committee substitute restoring the University of Kentucky Community College System; establish the Kentucky Technical Institution System to govern the operations of the vocational and technical schools; establish the Strategic Committee on Postsecondary Education as a temporary board to conduct the search for the first president of the Council on Postsecondary Education and grant the committee one vote for each group appointed by the General Assembly, the governor, and the Council on Postsecondary Education; establish the Kentucky Technical Institution System, to provide accessible education and customized training for business, industry and the general public and designate the responsibility of the institution system to the president; add the student member on the board of regents for the Kentucky Technical Institution System to the student body presidents nominating group for its representative on the Council on Postsecondary Education; grant one vote to each of the faculty, nonteaching staff and student members of the board of regents for the technical institution system; and restore provision designating the University of Kentucky as the principal provider of statewide research and service programs financed by state funds.
     HFA (63, D. Ford) - Require that the seven appointed members to a community college board of directors consist of four appointed by the Governor and three appointed by the county judge/executive of the county in which the community college is located.
     HFA (64, D. Ford) - Specify that four members of the board of directors shall be appointed by the Governor and four members of the board of directors shall be appointed by the county judge/executive of the county where the community college is located; assure that the appointments reflect the proportional representation of the two leading political parties of the Commonwealth, based on the state's voter registration.
     HFA (65, D. Ford) - Require that all appointed members to the board of directors of a community college must reflect the proportional representation of the two (2) leading political parties of the Commonwealth, based on the state's voter registration.
     HFA (66, B. Yonts) - Require the Council on Postsecondary Education by December 31, 1998, to establish rules and procedures to assure that all courses are transferable among postsecondary institutions, if there is a program to which a student wishes to transfer.
     HFA (67, K. Stein) - Reinstate the provision that designates the University of Kentucky the only institution that can receive state funds for research and service programs of a statewide nature.
     HFA (68, J. Callahan) - Provide that notwithstanding the provisions of KRS 11A.040, any person employed by the Council on Higher Education prior to the effective date of this Act may accept immediate employment with any governmental entity or any postsecondary education organization or institution in the Commonwealth; amend KRS 164 to provide that regionally accredited private institutions may apply for assistance awards from the Financial Aid and Assistance Trust Fund; and amend KRS 164.785 to restore eligibility for financial assistance to students in independent private colleges; amend Section 19, relating to the Kentucky Community and Technical College System (KCTCS) being the legal successor to the UK Community College System, to add a new subsection (7) to authorize full-time faculty members and staff persons to have tuition-free access to continuing education at the postsecondary institution of their choice; limit the number of hours per term or year to the institution's policy governing internal faculty's access to continuing education on the effective date of this act; require equal gender representation on the Council on Postsecondary Education and the Governor's Higher Education Nominating Committee; prohibit more than three members, as opposed to two, of the Council on Postsecondary Education or the Kentucky Community and Technical College Board, to reside in the same judicial district.; require that the members of the Governor's Higher Education Nominating Committee reflect the 2 leading political parties of the Commonwealth based on the state's voter registration; provide that the Council on Postsecondary Education shall not abolish or limit the total enrollment of the general 2-year course of general studies designed for transfer to a baccalaureate program offered at any community college; establish the right of graduates of a technical program within three (3) years of the program becoming an accredited degree program to receive partial or full credit toward a degree, based on criteria established by the board of regents for the Kentucky Community and Technical College System; and make minor technical changes.
     HFA (69, J. Arnold Jr.) - Extend eligibility for assistance under the technology initiative trust fund to not-for-profit private unversities.
     HFA (70, J. Arnold Jr.) - Amend various sections of KRS Chapter 164 to give authority of program approval for certificate, diploma, and associate degree programs to the board of regents for the Kentucky Community and Technical College System.
     HFA (71, G. Stumbo) - Provide that if the regional accrediting agency for the community colleges determines that the present organizational structure of the Kentucky Community and Technical College System and its board of regents does not meet the requirements for granting degrees by the University of Kentucky board of trustees, the Kentucky Community and Technical College board of regents shall take the corrective actions as necessary to alleviate the problem.
     HFA (72, T. Riner) - Incorporate a statement of the importance of ethics and morality into the educational training and personal development of its people for the advancement of the welfare of citizens of the Commonwealth.
     HFA (73, T. Riner) - Require that boards of postsecondary education institutions have philosophical diversity that assures the students will be provided diverse viewpoints when hiring faculty members in particular fields of study.
     HFA (74, T. Riner) - Provide that no institution of postsecondary education shall allow the direct or indirect use of its property, staff, or resources to censor ideas of speech because of religious content or to promote bigotry and; provide that there shall not be promotion of abortion, immorality, or the acceptance of homosexuality as a normal or healthy lifestyle.
     HFA (75, J. Lovell) - Restore provision authorizing the University of Kentucky as the principal institution to conduct statewide research and service programs financed by state funds.
     HFA (76, J. Lovell) - Amend Second Committee Substitute by removing regional universities as primary developers and deliverers of baccalaureate and master's degree distance learning programs, and assigning these duties to Council on Postsecondary Education.
     HFA (77, J. Callahan) - Permit community colleges to determine that the University of Kentucky or the community college manage funds specifically earmarked for an individual community college; designate the University of Kentucky the primary institution authorized to expend state general fund appropriations on research and service programs of a statewide nature; designate the Council on Postsecondary Education as the final authority to coordinate the offering of statewide service programs; and require the board of directors of a community college to recommend in rank order the candidates for the community college president.
     HFA (78, J. Callahan) - Amend the definition of the Kentucky Community and Technical College System to restore the community colleges to the administration of board of trustees of the University of Kentucky, who shall transfer the management responsibilities to the Kentucky Community and Technical College System; provide that the president of the community colleges be selected and employed by the board of regents of the system from a list of 3 candidates recommended by a 6-member search committee appointed by the board of trustees, composed of 2 board of regents members recommended by the board of trustees, 2 board of regents members recommended by the Postsecondary Education Nominating Committee, 1 student, faculty, or nonteaching personnel member of the board of regents representing the community colleges, 1 student, faculty, or nonteaching personnel member representing the technical institutions; permit the board of regents to terminate the employment of the chancellor of the University of Kentucky Community College System without cause; employees in the University of Kentucky community colleges as of June 30, 1998, shall be governed by the University of Kentucky administrative regulations as of June 30, 1998, and shall be provided the same benefit package available to other university employees; provide that the employees may elect to be governed by the personnel rules adopted by the board of regents; permit students to have the responsibilities, privileges, and rights accorded University of Kentucky Community College System students, as of July 1, 1998; establish that funds shall be appropriated to the University of Kentucky and allotted to the Kentucky Community and Technical College System for the benefit of the University of Kentucky Community Colleges; direct biennial budget requests to be prepared by the Kentucky Community and Technical College System but transmitted to the board of trustees for consideration and forwarded to the board of trustees for consideration and forwarded to the Council on Postsecondary Education with recommendations; provide that bonds shall be issued by the University of Kentucky; authorization for acquisition or and disposition of real property for the Community College System and capital construction projects for the use of the University of Kentucky Community College System shall be approved by the board of regents, which shall transmit the action to the University of Kentucky board of trustees for approval; the board of regents may appeal an action to the Council on Postsecondary Education, which shall retain final authority to review and approve all capital construction projects and real property acquisitions; provide that students may pursue 4 kinds of degree programs, which include associate degree programs approved and monitored by the board of trustees, who shall confer the degrees, new associate degree programs reviewed and approved by the board of regents prior to approval by the board of trustees, who shall confer the degrees, associate degree programs developed by the Kentucky Community and Technical College System, which are approved by the board of regents, who shall confer the degrees after approval by the Council on Postsecondary Education, and joint degree programs developed between the University of Kentucky Community College system and the Technical Institutions' Branch or other institutions.
     HFA (79, J. Barrows) - Amend KRS 164.2871 to authorize the governing board of each state postsecondary education institution to provide a self-insured employer group health plan to its employees.
     HFA (80, R. Palumbo) - Require the chancellor of the community colleges' branch and the board of regents of KCTCS to adopt budget and personnel policies which provide for maximum flexibility and autonomy of the community colleges, and require the board of directors for each community college to perform specified duties relating to the selection of a college president, development and monitoring of a strategic plan and annual plan, including budget priorities, and necessary consultation with the chancellor and the KCTCS board regarding the community college's needs.
     HFA (81, R. Palumbo) - Delete language specifying that funds transferred shall include all funds in escrow and funds and bequests specifically earmarked to community colleges, and replace with language requiring that the University of Kentucky continue to manage and invest funds in its accounts specifically earmarked for community colleges.
     HFA (82, R. Palumbo) - Make the Kentucky Community and Technical College System (KCTS) Board of Regents responsible for reviewing and approving diploma and associate degree programs, as opposed to the Council on Postsecondary Education; require approval by the KCTS board for associate degree programs offered at the University of Kentucky, the community colleges, Northern Kentucky University, and the University of Louisville.
     HFA (83, R. Palumbo) - Require the board of trustees of the University of Kentucky to provide community college programs at Lexington Community College comparable to those offered at community colleges that comprise the KCTCS; require LCC to maintain its comprehensive mission; provide that UK will continue to receive catch-up funding for LCC comparable to that received by the community colleges in the KCTCS and that UK will receive other funds earmarked for LCC through the KCTCS which will enable LCC to accomplish its strategic objectives.
     HFA (84, R. Palumbo) - Retain provisions of HFA 78, except delete requirement by which the present chancellor of the University of Kentucky Community Colleges serves as chancellor only at the pleasure of the board of regents of the new system.
     HFA (85, F. Rasche) - Permit Paducah Community College to continue to contract with the University of Kentucky for the protection of its facilities and funds, and be subject to the management of the Kentucky Community College and Technical System.
     SCA (1, D. Williams) - Create an adult education and literacy initiative fund to address problems of adult education and literacy.
     SCA (2, E. Scorsone) - Eliminate the Strategic Committee on Postsecondary Education.
     SCA (3, N. Kafoglis) - Amend HB1/GA to stipulate poverty guidelines for recipients of the "financial aid and advancement trust fund" and use of remaining funds.
     SCA (4, N. Kafoglis) - Amend HB1/GA to require the Council on Postsecondary Education to resolve conflicts between the KCTC board of regents and the UK board of trustees.
     SCA (5, E. Scorsone) - Provide fair and equitable funding for Lexington Community College, and allow UK to provide community college programs.
     SCA (6, J. Westwood) - Amend KRS 164.365 to direct the board of regents for the Kentucky Community and Technical College System to establish a salary schedule for faculty and staff of the system.
     SCA (7, J. Westwood) - Require Kentucky Community and Technical College System Board to deduct employee membership organization dues on written authorization from the employee.
     SCA (8, D. Karem) - Delete provision requiring the new board of regents established for postsecondary institutions and the University of Kentucky and the University of Louisville to provide students with different scholarly viewpoints when hiring, promoting, and granting tenure to faculty members in particular fields of study; and delete additional language prohibiting censorship, compulsion, and the imposition of "politically correct" requirements which interfere with free expression of ideas.
     SCA (9, D. Karem) - Include the University of Kentucky, University of Louisville, community colleges, vocational schools, and independent colleges as providers of academic programs via distance learning.
     SCA (10, N. Kafoglis) - Change selection process for choosing the president of the Council on Postsecondary Education; fix term of contract and terms of renewal for the president of the council.
     SCA (11, L. Casebier) - Add requirements to overall membership of Council on Postsecondary Education.
     SCA (12, L. Casebier) - Create expert panel to evaluate Research Trust Fund applications for both universities.
     SCA (13, L. Casebier) - Council quorum needed for president dismissal changed from 8 to 10 members.
     SCA (14, E. Scorsone) - Grant the board of regents of the KCTCS the power to suspend or remove any teacher, professor, or employee for incompetence, neglect of, or refusal to perform their duties, or for immoral conduct; allow the teacher, professor, or employee not to be removed until they have been notified in writing for a period of ten (10) days, in which time they can appeal to the board in the form of a hearing.
     SCA (15, L. Casebier) - Allow for private funds to be part of those funds earmarked for the community college system, to be managed by UK or the local community college.
     SCA (16, G. Williams) - Change wording for education implementation plans; make minor technical changes.
     SCA (17, G. Williams) - Eliminate financial reporting requirement for the Finance and Administration Cabinet, concerning general and road fund revenue; renumber subsequent sections of the Act.
     SCA (18, E. Harris) - Add language to clarify that a social security number shall not be required to identify a sudent's academic records.
     SCA (19, E. Harris) - Ensure that the community college programs are of high enough quality to facilitate the transfer of their students to four-year programs.
     SCA (20, B. Bailey) - Allow any regular full-time employee, with prior administrative approval, to take a maximum of six credit hours per term, with tuition being waived; combine former subsection "(8)" with current subsection "(7)".
     SCA (21, R. Stivers) - Delete the stipulation that the General Assembly is to make appropriations to individual trust funds in a form and manner that is consistent with the strategic agenda adopted by the Council on Postsecondary Education.

     SCA (24, G. Williams) - Remove student financial aid and advancement trust fund as an individual strategic investment and incentive trust fund; and require the Council on Postsecondary Education to recommend to the General Assembly new strategies for providing financial assistance.
     SCA (25, V. McGaha) - Amend HB1/GA to eliminate the Department for Technical Education; establish the president of the KY Community and Technical College System as the CEO; and specify duties of CEO.
     SCA (26, E. Harris) - Amend HB1/GA to require a strategic agenda be reviewed by the Governor and the General Assembly; outline reporting requirements and process of review; require the council to report on the status of the implementation of the strategic agenda; require a public forum to exchange ideas about the progress of the agenda.
     SCA (27, E. Harris) - Amend General Assembly version of House Bill 1 to allow associations representing independent, nonprofit colleges and universities to submit a recommendation to the governor for members of the Postsecondary Education Nominating Committee.
     SCA (28, E. Scorsone) - Add language to the Council on Postsecondary Education's responsibilities that states the council shall have the final authority to determine compliance of postsecondary institutions with their academic, service, and research missions; add clarifying language regarding the University of Kentucky's statewide research and service mission; and add a statement that the university may enter into joint research and service activities.
     SCA (29, G. Williams) - Add a responsibility to the council to include in the strategic agenda the academic programs to be made available to the citizens of the Commonwealth; add a statement that recognizes the needs of a major metropolitan area, served by Northern Kentucky University, and a collaborative effort between Northern Kentucky University with the doctoral degree granting universities; add language that requires the involvement of the nine (9) state postsecondary education institutions, the executive director of the Kentucky Educational Television Network, a representative of the Association of Independent Kentucky Colleges and Universities, and other representatives the council deems appropriate, in the development of the Commonwealth Virtual University; and add language that clarifies that while the regional universities are the primary provider of baccalaureate and master's degree programs, that shall not preclude the University of Kentucky and the University of Louisville, independent colleges, technical institutions and community colleges from offering degrees and course offerings through the Commonwealth Virtual University.
     SCA (30, G. Williams) - Add a statement that allows a faculty member of a postsecondary institution to serve on the Council on Postsecondary Education.
     SCA (31, G. Williams) - Amend GA copy of House Bill No. 1 so that all references to "state-supported" are changed to "public".
     SCA (32, D. Seum) - Require Council on Postsecondary Education to ensure that board and faculty of postsecondary education institutions provide instruction without discriminating against students with contrary political views.
     SCA (33, R. Stivers) - Limit service on the Council on Postsecondary Education, University of Kentucky board of trustees, Kentucky Community and Technical College System board of regents, and University of Louisville board of trustees to no more than two consecutive full six-year terms.
     SFA (34, G. Freeman) - Restore the University of Kentucky's authority over the existing community college system; elevate the postsecondary institutions in the Kentucky Tech System to a level equal to a regional university; name the new system the Kentucky Technical College System and establish a board of regents to govern the new system; establish powers and duties of the board of regents of the Kentucky Technical College System; amend numerous KRS sections to conform.
     SFA (35, G. Freeman) - Restore to the University of Kentucky the complete authority over the budgets of the community colleges under the KCTCS and Lexington Community College.
     SFA (36, E. Scorsone) - Provide that regional universities will work cooperatively with the University of Kentucky, the University of Louisville, community colleges and other postsecondary institutions, to assure access in every region of the Commonwealth to baccalaureate and master's degrees of a quality at or above the national average.
     SFA (37, E. Harris) - Affirm the student's right to choose an academic or vocational program of study and define the term "business".
     SFA (38, E. Harris) - Eliminate the Council on Postsecondary Education from responsibility for the approval of certain Associate Degree Programs. Make the board of regents of the Kentucky Community and Technical College System responsible for the approval of Associate Degree programs.
     SFA (39, E. Harris) - Amend General Assembly version of House Bill 1 to increase the specificity of the duties of the Council on Postsecondary Education, to move a section of the bill pertaining to the Council's responsibility for establishing and maintaining a comprehensive database on postsecondary education, and to restore language currently codified in statute that requires the Council to collect information on students, faculty, programs, and the use of facilities to be used in measuring the institution's performance during the accountability process.
     SFA (40, E. Harris) - Omnibus revision of the General Assembly version of House Bill 1 restoring the University of Kentucky Community College System; establish the Kentucky Technical Institution System to govern the operations of the vocational and technical schools; establish the Strategic Committee on Postsecondary Education as a temporary board to conduct the search for the first president of the council on Postsecondary Education and grant the committee one vote for each group appointed by the General Assembly, the governor and the Council on Postsecondary Education; establish the Kentucky Technical Institution System to provide accessible education and customized training for business, industry and the general public and designate the responsibility of the institution system to the president; make the commission of education on the Council of Postsecondary Education a nonvoting member; add the student member on the board of regents for the Kentucky Technical Institution System to the student body presidents nominating group for its representative on the Council on Postsecondary Education; grant one vote to each of the faculty, nonteaching staff and student members of the board of regents for the technical institution system and restore provision designating the University of Kentucky as the principal provider of statewide research and service programs financed by state funds.
     SFA (41, J. Rose) - Create a new section of KRS Chapter 164 to prohibit the appointment of a person to the board of regents of the Kentucky Community and Technical College System, the Council on Postsecondary Education, or the Strategic Committee on Postsecondary Education if the person, the members of the person's immediate family, or the person and the members of his immediate family combined have contributed more than $1,000 to the Governor's campaign committee or more than $1,000 to the Governor's political party; prohibit an appointee to the board of the KCTCS, the CPE, or SCOPE, and his immediate family, from contributing to a Governor's campaign account, to the Governor's political party, or to a candidate for the General Assembly during the term for which the person is appointed; apply the prohibitions to contributions made for campaigns to a Governor's campaign or to the party to contributions made for elections for Governor beginning in 1999 and thereafter, and apply the prohibition against contributions to a candidate for the General Assembly to contributions made after the date of the appointment; define "immediate family" to include the appointee's spouse, the parent of the appointee or spouse, and the child of the appointee or spouse; require the Attorney General to examine each applicable appointment to determine whether the appointment is prohibited, and if so, require the Attorney General to seek a declaratory judgment to that effect, which will require the forfeiture of the appointment.
     SFA (42, J. Rose) - Establish the Council on Postsecondary Education to include the Commissioner of Education as a nonvoting member, a faculty member, a student member, and 13 citizen members; 7 of the citizen members appointed to the initial council shall be current members of the Council on Higher Education who have the last terms to expire of all the current members appointed to the Council on Higher Education; 6 of the citizen members appointed to the initial council shall be appointed by the Governor.
     SFA (43, J. Rose) - Create a new section of KRS Chapter 164 to apply the same restrictions and protections regarding political activity by appointees to the board of regents of the Kentucky Community and Technical College System, the Council on Postsecondary Education, and the Strategic Committee on Postsecondary Education as those that are applied to merit system employees under KRS 18A.140.
     SFA (44, V. McGaha) - Direct the Kentucky Community and Technical College System to study alternative governance structures for the state-supported area technology centers, and report findings and recommendations by October 1, 1999.
     SFA (45, R. Stivers) - Delete the requirement that the Council on Postsecondary Education shall establish regional advisory groups to develop strategies for workforce development.
     SFA (46, R. Stivers) - Permit the board of each state postsecondary institution to provide a self-insured employer group health plan which shall be exempt from conformity with other provisions of KRS Chapter 304, rather than exempt from Subtitle 17A of KRS Chapter 304.
     SFA (47, R. Stivers) - Require the chancellor of the community colleges' branch and the board of regents of KCTCS to adopt budget and personnel policies which provide for maximum flexibility and autonomy of the community colleges and require the board of directors for each community college to perform specified duties relating to the selection of a college president, development and monitoring of a strategic plan and annual plan, including budget priorities, and necessary consultation with the chancellor and the KCTCS board regarding the community college's needs; provide that budget guidelines developed for the community colleges provide for the review and recommendation, rather than approval, of budget proposals by the KCTCS board.
     SFA (48, R. Stivers) - Delete language permitting the Kentucky Community and Technical College System board of regents to appeal the University of Kentucky board of trustees' actions on capital construction projects and real property acquisitions to the Council on Postsecondary Education.
     SFA (49, R. Stivers) - State goal that the regional universities are to be working cooperatively with "the University of Kentucky, the University of Louisville, and community colleges," as well as other postsecondary institutions, and require access in every region, rather than statewide access, to certain degrees.
     SFA (50, E. Scorsone) - Retain current governance of the University of Kentucky Community College System with the U.K. Board of Trustees; allow the Kentucky Community and Technical College System to review and approve degree programs and review and approve the budget of the U.K. community colleges prior to action by the U.K. board of trustees; remove the provision allowing nominees by the University of Kentucky for the Kentucky Community and Technical College board of regents and the representation on the Kentucky Community and Technical College board of regents by the Community College faculty, nonfaculty personnel, and students.
     SFA (51, D. Karem) - Add a statement to the mission of regional universities to develop at least one (1) nationally-recognized program of distinction or one (1) nationally-recognized applied research program; add definitions for benchmarks as objective measures to judge the performance of the postsecondary education system and progress toward the goals; add a definition of goals as referenced in Section 2 of the Act; make clarifying technical changes to distinguish between statewide strategic agenda and strategic implementation plan; provide that the personnel positions of the Council on Higher Education as of the effective date of this Act be transferred to the Council on Postsecondary Education; provide that all staff of the Council on Postsecondary Education be transferred at the same pay and benefits at the time of transfer; clarify language relating to the preparation of an implementation plan to achieve the strategic agenda by the Council on Postsecondary Education; clarify purposes of the technology initiative trust fund to support investments in electronic technology for postsecondary education throughout the Commonwealth to improve student learning; clarify the purpose of the physical facilities trust fund to provide sufficient financial assistance for unexpected contingencies for the construction, improvement, renovation of postsecondary facilities and that the fund is not intended to replace the existing capital construction and appropriations provisions in current state law; add a statement that a minimum of twenty-five (25%) of the fund appropriation under the student financial aid and advancement trust fund shall be used for the purpose of assisting individuals whose family income is at or below one hundred percent (100%) of the federal income poverty guidelines and individuals with predetermined disabilities; provide that the chancellors of the Kentucky Community and Technical College System shall be appointed by the board of regents for the system upon the recommendation of the president from names provided by a search committee; and provide that the existing chancellor of the community colleges at the effective date of this Act shall serve as the first chancellor in the new system and that when a new chancellor is needed to head the community colleges that a search committee shall be composed of equal representation of appointees from the board of regents and the board of trustees for the University of Kentucky; establish the transfer date of the management responsibilities for the University of Kentucky Community College System from the University of Kentucky to the Kentucky Community and Technical College System shall be effective upon the affirmative completion of the regional accrediting agency's substantive change process, but not later than July 1, 1998; clarify that any funds raised by a not-for-profit or nonprofit organization shall be used for the specific program or community college designated; provide that the board of regents for the Kentucky Community and Technical College System may divide assets and funds among the specific organizations and institutions within the community college system to meet the mission of the system, but funds held in escrow or invested solely for the purpose of a community college and bequests specifically earmarked for a community college may at the discretion of that local community college be managed by the University of Kentucky or that local community college; provide that the Council on Postsecondary Education settle any conflicts between the University of Kentucky board of trustees and the board of regents for the Kentucky Community and Technical College System; delete section on personnel dispute resolution by an independent third party as a requirement for the board of regents of the Kentucky Community and Technical College System; create a new section that describes the process the Council on Postsecondary Education may use to identify academic programs offered at institutions to which the criteria for a standardized degree program shall be applied and delete the reference to the topic as a required duty under the council's duties; add language that requires gender balance on appointments to the Governor's Postsecondary Education Nominating Committee, board of regents for the Kentucky Community and Technical College System, and the Council on Postsecondary Education and add statement of the nominating groups providing nominees of a single sex if it is necessary to maintain balance; add a clarifying statement that existing members of boards of trustees, boards of regents, and the council may be reappointed and serve two (2) additional full consecutive terms; add a statement requiring that the Governor's Postsecondary Education Nominating Committee must provide nominees for the board of regents for the Kentucky Community and Technical College System no later than thirty (30) days after the effective date of this Act and the University of Kentucky board of trustees must provide names by June 10, 1998 to the Governor; provide that the board of directors of the community college shall recommend one (1) candidate for the community college president from three (3) candidates provided by the president of the Kentucky Community and Technical College System and that the president of the system has the final authority and does not have to be bound by the board of directors' recommendation; add a non-codified section that states that the current Council on Higher Education members' terms expire upon the effective date of this Act but that they may continue to serve until new members are appointed; and make conforming technical changes.
     SFA (52, R. Leeper) - Establish the Council on Postsecondary Education to include the commissioner of education and six members to be appointed from each of the congressional districts.
     SFA (53, R. Leeper) - Direct the Governor to appoint at least three members of the Council on Higher Education to the newly created Council on Postsecondary Education.
     SFA (54, R. Leeper) - Establish the Council on Postsecondary Education to include the commissioner of education and seven citizen members appointed from each of the seven judicial districts.
     SFA (55, R. Leeper) - Direct the Governor to appoint at least three members of the Council on Higher Education to the newly-created Council on Postsecondary Education
     SFA (56, D. Karem) - Direct the Governor to consider the 16 citizen members serving on the Council on Higher Education on the effective date of this Act in addition to 26 nominees from the Postsecondary Education Nominating Committee when making the initial appointments to the Council on Postsecondary Education; direct the Governor to appoint at least 6 citizen members serving on the Council on Higher Education on the effective date of this Act.
     SFA (57, G. Williams) - Define standardized degree program as a statewide degree program; provide that faculty advisors from the respective disciplines will resolve conflicts between institutions when deciding the core courses of the statewide programs.
     SFA (58, J. Rose) - Delete the requirement that the Council on Postsecondary Education shall establish regional advisory groups to develop regional strategies for workforce development.
     SFA (59, J. Rose) - Require written permission of student or if, a minor, parental consent, for postsecondary educational institutions to release identifiable student information.
     SFA (60, J. Rose) - Allow appointment for the CPE president by contract not to exceed 5 years, but renewable at the pleasure of the council.
     SFA (61, W. Blevins) - Prohibit the reassignment of the mission for health professions education, research, and development from the University of KY to any other postsecondary educational institution.
     SFA (62, W. Blevins) - Require the University of Kentucky board of trustees rather than the Kentucky Community and Technical College System board of regents to take corrective action if the regional accrediting agency for the community colleges determines that the present organizational structure of the Kentucky Community and Technical College System and its board of regents does not meet the requirements for granting degrees by the University of Kentucky board of trustees.
     SFA (63, W. Blevins) - Provide that the board of directors for each community college system under the KCTCS shall consist of one (1) member of faculty rank.
     SFA (64, W. Blevins) - Amend KRS 164.365 to include a requirement that the Board of Regents for the Kentucky Community and Technical College System protect the academic freedom of faculty and students; describe academic freedom; prohibit academic careers from being jeopardized by activities of academic freedom; direct that faculty determine course content and textbooks in conjunction with the criteria for accreditation; require the board of regents of KCTCS to protect faculty against influences that would restrict them in exercises of academic freedom; advise faculty members speaking or writing as citizens or members of professional and other groups to indicate they are not speaking for KCTCS and advise them against using KCTCS materials; direct that faculty members be free to engage in political activities consistent with the law and their obligations as teachers and scholars; allow faculty members to file grievances in accordance with procedures established by the KCTCS.
     SFA (65, J. Rose) - Require 7 of the 13 original appointments to the Council on Postsecondary Education to be current members of the Council on Higher Education; require the members with the terms that will expire last on the Council on Higher Education to be the individuals appointed to the Council on Postsecondary Education; provide for the Governor to make all 13 appointments thereafter.
     SFA (66, N. Kafoglis) - Make the faculty and student members on the Council on Postsecondary Education nonvoting members.
     SFA (67, N. Kafoglis) - Require an external expert panel to evaluate University of Kentucky and University of Louisville Research Trust Fund applications that propose research studies.
     SFA (68, N. Kafoglis) - Provide that a search firm interview and propose three (3) or more candidates for the position of president of the Council on Postsecondary Education; provide that the president of the council shall be provided a contract to serve for a term not to exceed five (5) years, which is renewable at the pleasure of the council; and make conforming technical changes.
     SFA (69, N. Kafoglis) - Require the vote of two-thirds of the membership in order to dismiss the president of the Council on Postsecondary Education.
     SFA (70, N. Kafoglis) - Direct the Kentucky Community and Technical College System, the Workforce Development Cabinet, and the Department of Education to study alternative governance structures for the state-supported area technology centers, require that the views of interested parties be sought, and report findings and recommendations to the Governor, the Legislative Research Commission, and the Interim Joint Committee on Education by October 1, 1999.

provide that the Council on Postsecondary Education ensure that all postsecondary education institutions are committed to providing instruction free of discrimination against students who hold political views and opinions contrary to those of the governing board and faculty; extend the privilege to all full-time faculty and staff in public postsecondary institutions of taking up to six (6) credit hours per term, tuition-free, at any state-supported postsecondary institution; add clarification about Lexington Community College's eligibility to receive improvement funds during the 1997-98 fiscal year and the future biennial budget requests shall be as a line item in the University of Kentucky's budget request; add a statement requiring that the Governor's Postsecondary Education Nominating Committee must provide nominees for the board of regents for the Kentucky Community and Technical College System no later than thirty (30) days of the effective date of this Act and the University of Kentucky board of trustees must provide names by June 10, 1997 to the Governor; provide that the board of directors of the community college shall recommend one (1) candidate for the community college president from three (3) candidates provided by the president of the Kentucky Community and Technical College System and that the president of the system has the final authority and does not have to be bound by the board of directors' recommendation; require the KCTCS board of regents and UK board of trustees to initiate corrective action if the regional accrediting agency for the community colleges determines that the organizational structure of KCTCS does not meet their accrediting requirements; provide that the name of community colleges at the effective date of this Act shall be retained; add a non-codified section that states that the current Council on Higher Education members' terms expire upon the effective date of this Act but that they may continue to serve until new members are appointed; and make conforming technical changes.
