HB 290/LM (BR 1338) - A. Simpson, B. Colter

     AN ACT relating to criminal justice matters.
     Create a new section of KRS Chapter 534 to establish procedure for imposing the costs of incarceration against convicted felons; create a new section of KRS Chapter 197 to require the Department of Corrections to determine the estimated cost of incarceration on an annual basis, and to provide those figures to the courts; amend KRS 534.045 to require the assessment of a reimbursement fee against prisoners confined in county jails to offset the cost of incarceration; create a new section of KRS Chapter 534 to allow the issuance of criminal garnishment orders for all fines, fees, court costs, restitution, or reimbursement charges owed by a convicted person; create a new section of KRS Chapter 534 to require garnishees to transfer property; create a new section of KRS Chapter 534 to provide for a collection fee for clerks; create a new section of KRS Chapter 534 to provide for the eventuality that a garnishee does not comply with the order of the court; create a new section of KRS Chapter 534 to prevent discharge of an employee because of a criminal garnishment; create a new section of KRS Chapter 534 to establish a lien against wages earned by a convicted person; create a new section of KRS Chapter 534 to establish liens and to provide for the enforcement of liens; create a new section of KRS Chapter 534 to require the Administrative Office of the Courts to prepare and distribute necessary forms; establish terms of construction; provide that the provisions of the Act become effective only upon the ratification of BR 1349, proposing a Constitutional amendment to allow the Commonwealth to recoup the costs of incarceration from prisoners, by the voters of the Commonwealth.
