     AN ACT relating to employment.
     Create a new section of KRS 337.420 to 337.433 to outline the purpose and declarations of the pay equity provisions; amend section KRS 337.420 to include definitions relating to pay equity; amend KRS 337.423 to prohibit an employer from practicing wage discrimination based on sex, race, or national origin and requires the Department of Workplace Standards to promulgate administrative regulations; create new section of KRS 337.420 to 337.433 to require record keeping and to establish criteria for record information; amend KRS 337.427 to provide remedies for employees who experience wage discrimination; amend KRS 337.430 to extend from 6 months to 2 years the period to file a wage discrimination action; and create a new section of KRS 337.420 to 337.433 to name the legislation the "Fair Pay Act of 2000".

HB 12 - AMENDMENTS


     HFA (1, S. Cave) - Amend to create a new section in KRS Chapter 336, to prohibit, as a condition of employment or continued employment, mandatory membership or participation in a labor union.
     HFA (2, S. Cave) - Amend to create a new section in KRS Chapter 336, to prohibit, as a condition of employment or continued employment, mandatory membership or participation in a labor union; amend KRS 336.990 to assess a Class A misdemeanor penalty.
     HFA (3, S. Cave) - Retain original provisions, except amend Section 3(2) to require that differences in pay, due to complying with prevailing wage requirements shall not be deemed an unlawful employment practice for the purposes of this Act; amend KRS 337.010 to exempt building constructed for education purposes and construction projects conducted by a city, county, charter county, urban-county government or school district unless the project is financed with 50% or more state funds, from prevailing wage provisions.
     HFA (4, J. Jenkins) - Amend to delete "tips" from the definition of "Wage rate".
     HFA (5, J. Jenkins) - Amend definition of "Employer" to mean one with 8 or more, instead of 2 or more, employees employed in 20, instead of 12 calendar weeks.
     HFA (6, J. Jenkins) - Amend to delete Section 4 that requires record keeping and record information.
     HFA (7, J. Jenkins) - Retain original provisions, except amend KRS 337.427 to restore language making an employer violating provisions of KRS 337.423 liable to an employee affected for the amount of his or her unpaid wages, and when a willful violations occurs, making the employer liable for up to an additional equal amount as liquidated damages, instead of making an employer liable for unpaid wages and an additional amount in compensatory and punitive damages as appropriate.
     HFA (8, J. Jenkins) - Amend KRS 337.430 to permit a court action under KRS 337.420 to 337.433 and KRS 337.990(14) to commence no later than six months instead of two years after a cause of actions occurs.
     HFA (9, S. Cave) - Retain original provisions, except amend Section 7 to permit the Act to be cited as the "Lawyer's Full Employment Act" instead of the "Fair Pay Act of 2000."
     HFA (10, S. Cave) - Retain original provisions, except amend Section 7 to permit the Act to be cited as the "Increased Government Paperwork and We Don't Want Any Businesses in Kentucky Act" instead of the "Fair Pay Act of 2000."
     HFA (11, J. Jenkins) - Amend to delete all provisions of the bill after the enacting clause; create a findings and declarations provision; amend KRS 337. 420 to make provisions applicable to an employer with eight or more employees, rather than 2 or more, amend KRS 337.423 to add race and national origin to prohibition against wage discrimination and delete reference to the Fair Labor Standards Act (FLSA).
     HFA (12, M. Treesh) - Amend floor amendment #11 to revise purpose clause.
