SB 20/LM (BR 55) - T. Buford, A. Kerr

     AN ACT relating to retirement.
     Amend KRS 61.690 to include urban-county fire and police pension funds in tax schedules for purposes of KRS 141.010 and 141.0215; amend KRS 67A.492 to provide a surviving widow of a retired urban-county fire or policeman the same benefits regardless of date of retirement of the deceased member; amend KRS 67A.690 to change retiree annual increases to reflect possible retirement age of 47 rather than 51.

SB 20 - AMENDMENTS


     SCS/LM - Retain original provisions except delete the provision providing tax treatment of pensions pursuant to KRS 141.010 to 141.0215 as it is already provided by KRS 67A.350; amend KRS 67A.620 to provide that members' pensions shall not be considered marital property in divorce cases; and further amend KRS 67A.690 to provide that members retired on a duty-related disability be entitled to the same annual increase as regular retirees, which may be 2-5% as determined by the board, rather than a flat 2%.
     SFA (1, E. Scorsone) - Amend 67A.430 to provide that any retiree or surviving spouse receiving a monthly annuity of less than $1,000 shall have the annuity increased to $1,000; delete proposed amendment to KRS 67A.492.
     SFA (2, D. Williams) - Create a new section of KRS 61.510 to 61.705 to provide that any employee of any state-administered retirement system who is killed or disabled as a result of a duty-related injury, as defined, will receive enhanced death and disability benefits similar to those provided hazardous employees; amend KRS 61.702 to provide enhanced insurance benefits for employees killed or disabled in a duty-related injury; amend KRS 78.545 to provide conforming reference.
     HCA (1, D. Butler) - Delete the new section of KRS 61.510 to 61.705 relating to benefits for duty-related death and disability for employees in state-administered retirement systems and delete conforming amendments to KRS 61.702 and 78.545.
     HCA (2, C. Belcher) - Delete changes to KRS 67A.620 dealing with consideration of marital property in divorce cases and renumber remaining sections and internal references.
     HFA (1, P. Clark) - LRC shall appoint a Task Force on the County Employees Retirement System; define membership and issues.
     HFA (2, J. Jenkins) - Amend to delete provisions exempting pension benefits from classification as marital property upon divorce.
     HFA (3/AA, H. Collins) - Amend KRS 161.220 to provide that members who have at least 27 years of service and whose service and age total at least 80 receive final compensation based on their high 3 years.
     HFA (4, J. Draud) - Amend KRS 6.505 to authorize a member of the Legislators' Retirement Plan who would qualify for membership in the Kentucky Employees Retirement System, State Police Retirement System, County Employees Retirement System, or Teachers' Retirement System to transfer out of the Legislators Retirement Plan and into the other retirement system, employer and employee contributions are to be transferred to the receiving system, member shall pay the difference, if any between the amount of funds transferred by the Legislators' Retirement Plan and the cost of the credit to the system accepting the transfer as determined by the receiving system's actuary.
     HFA (5, F. Nesler) - Create new section amending KRS 95.520 to require 3rd class cities to certify all police and firefighters as hazardous duty and require that those remaining in the city system be provided the same benefits as provided to CERS members under KRS 61.592.
     HFA (6/P, T. Riner) - Attach the provisions of HB 52 which deletes the language in KRS 21.450(3) stating, "Any accrual of benefits provided under this or any other applicable statute shall be no less than the benefit adjustment provided for in KRS 21.405(4) from the date of the last establishment of that benefit."
     HFA (7, F. Nesler) - Amend KRS 95.520 to require cities of the 3rd class to place all CERS police and firefighters under hazardous duty classification.
     HFA (8, J. Vincent) - Amend KRS 61.592 to require all counties in CERS to provide hazardous retirement for their peace officers and require that cities and counties whose peace officers are not covered in CERS provide benefits equal to those provided to hazardous members under KRS 61.592.
