Kentucky Board of Licensure for Private Investigators
(Amendment)

201 KAR 41:040.Fees.

Section 1.

Private Investigator Application Fees. An individual applicant for licensure as a private investigator shall submit an initial licensure fee of $400. the following fees:

(1)

 

(a)

The initial application fee for licensure as a private investigator shall be $400.

(b)

The fee shall be submitted to the board as follows:

(a)1.

$100 shall be due within thirty (30) days of submission of the application. This fee shall be non-refundable; and

(b)2.

$300 shall be due at the time the applicant submits proof of a passing examination score. This fee shall be refunded if the applicant is denied a license.

(2)

 

(a)

The fee for the criminal history, background check, and fingerprinting shall be remitted to the Kentucky State Treasurer in an amount pursuant to 502 KAR 30:060 and 28 C.F.R. 16.33.

(b)

Contact the Department of Professional Licensing for the current fee amount or check the board's Web site at http://kpi.ky.gov/Pages/default.aspx.

Section 2.

Private Investigator Company Application Fees.

(1)

In addition to the individual licensure fees established above, the The initial application fee for licensure as a private investigator company shall be:

(a)

$100 for a sole proprietorship; or

(b)

$400 for a firm, association, partnership, corporation, nonprofit organization, or institution.

(2)

The initial application fee shall be submitted within thirty (30) days of the application.

Section 3.

Examination Fee.

(1)

The examination fee shall be the actual amount charged by the examination service for the examination pursuant to a contractual agreement with the board.

(2)

The examination fee shall be paid directly to the examination service.

Section 4.

Biennial Renewal License Fee.

(1)

The fee for renewal of a private investigator license shall be $250.

(2)

The fee for renewal of a private investigating company license shall be $250.

Section 5.

Late Renewal Fee.

(1)

Late renewal fees shall be in addition to license renewal fees established in Section 4 of this administrative regulation.

(2)

The fee for late renewal of a private investigator license, submitted for renewal between July 1 and September 1August 31, shall be $100$250.

(3)

The fee for late renewal of a private investigating company license, submitted for renewal between July 1 and September 1August 31, shall be $100$250.

Section 6.

Reinstatement Fee.

(1)

Reinstatement fees shall be in addition to license renewal fees established in Section 4 of this administrative regulation and late renewal fees established in Section 5 of this administrative regulation.

(2)

The fee for reinstatement of a private investigator's license terminated pursuant to KRS 329A.045(8) shall be $250 $100.

(3)

The fee for reinstatement of a private investigating company license terminated pursuant to KRS 329A.045(8) shall be $250 $100.

Section 7.

Inactive Status Fee.

(1)

The fee for placing a license in inactive status shall be $100.

(2)

The fee for renewal of a license in inactive status shall be $100.

(3)

The fee to reactivate an inactive license pursuant to 201 KAR 41:065 shall be $250.

Section 8.

Duplicate License Fee. The fee for a duplicate license or certificate shall be twenty-five (25) dollars.

Section 9.

Continuing Education Program Application Fee.

(1)

The annual fee for an application for approval of a continuing education program shall be fifty (50) dollars.

(2)

The fee shall be applicable to all continuing education providers except those who do not require board approval pursuant to 201 KAR 41:070, Section 3.

Section 10.

Temporary Employee Registration Fee. A private investigator or private investigating firm employing a person for less than 240 hours per year pursuant to 201 KAR 41:100 shall pay a fee of twenty (20) dollars per temporary employee at the time of registration.

PUBLIC HEARING AND COMMENT PERIOD: A public hearing on this administrative regulation shall be held on December 21, 2026, at 9:00 a.m., eastern time, in the Kentucky Board of Licensure for Private Investigators, 500 Mero Street, First Floor, Frankfort, Kentucky 40601. Individuals interested in being heard at this hearing shall notify this agency in writing by five working days prior to the hearing of their intent to attend. If no notification of intent to attend the hearing is received by that date, the hearing may be canceled. The hearing is open to the public. Any person who wishes to be heard will be given an opportunity to comment on the proposed administrative regulation. A transcript of the public hearing will not be made unless a written request for a transcript is made. If you do not wish to be heard at the public hearing, you may submit written comments on the proposed administrative regulation. This amendment reduces the late application fee from $250 to $100. The amendment increases the reinstatement fee from $100 to $250.

This proposed amendment is necessary to ensure that Kentucky’s private investigation licensure fees conform with similar fees in neighboring states.
(c) How the amendment conforms to the content of the authorizing statutes:
KRS 319A.025 authorizes the board to promulgate administrative regulations establishing fees in order to carry out its statutory mandates. This proposed amendment adjusts those fees to conform to fees in neighboring states.

This proposed amendment will help the board carry out its statutory mandates by establishing fair licensure fees.

This regulation will affect an unknown number of applicants for licensure as private investigators. This regulation will also affect the board.

(a) List the actions that each of the regulated entities identified in question (4) will have to take to comply with this administrative regulation or amendment:
Licensure applicants will pay less if they submit a late application. Licensure applicants will pay slightly more if they seek to reinstate their licenses.
(b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (4):
Licensure applicants already had to pay certain fees. This amendment reduces the late application fee from $250 to $100. The amendment increases the reinstatement fee from $100 to $250.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (4):
Compliance will keep Kentucky in line with private investigator licensing fees in neighboring jurisdictions.

There are no anticipated initial costs to administer this regulatory amendment.

Any department costs of implementation will be met with existing agency funds.

Licensure applicants already had to pay certain fees. This amendment reduces the late application fee from $250 to $100. The amendment increases the reinstatement fee from $100 to $250.
