Board of Medical Imaging and Radiation Therapy
(Amendment)

201 KAR 46:030.Education for medical imaging technologists, advanced imaging professionals, nuclear medicine technologists, radiographers, and radiation therapists.

Section 1.

Curricular Standards for Medical Imaging, Radiation Therapy, Radiography, Nuclear Medicine, and Advanced Imaging Programs. Educational programs shall ensure:

(1)

Radiography and radiation therapy programs meet the curricular standards established by the American Society of Radiologic Technologists (ASRT);

(2)

Nuclear medicine programs meet the curricular standards established by the Society of Nuclear Medicine and Molecular Imaging Technologists Section (SNMMITS); and

(3)

Programs maintain accreditation by the Joint Review Committee on Education in Radiologic Technology, the Joint Review Committee on Educational Programs in Nuclear Medicine Technology, or other accrediting agencies recognized by the American Registry of Radiologic Technologists (ARRT), which have been approved by the board.

Section 2.

Student Employment Outside the Academic Clinical Setting. A student shall not be employed in the operation of radiation-producing equipment or the administration of ionizing radiation for the purpose of medical imaging or radiation therapy in Kentucky unless they hold an active Temporary Student Radiography License pursuant to 201 KAR 46:045.

PUBLIC HEARING AND COMMENT PERIOD: A public hearing on this administrative regulation shall be held on January 27, 2026 at 10:00 am at 2365 Harrodsburg Rd, Suite A220, Lexington KY 40504. Individuals interested in being heard at this hearing shall notify this agency in writing by five workdays prior to the hearing, of their intent to attend. If no notification of intent to attend the hearing was received by that date, the hearing may be cancelled. A transcript of the public hearing will not be made unless a written request for a transcript is made. If you do not wish to be heard at the public hearing, you may submit written comments on the proposed administrative regulation. Written comments shall be accepted through January 31, 2026. (1) Provide a brief summary of:
(a) What this administrative regulation does:
This administrative regulation establishes uniform curricula standards for postsecondary educational institutions and further establishes parameters for students working outside their academic clinical setting.
(b) The necessity of this administrative regulation:
The necessity of this regulation is to approve accredited educational programs and monitor compliance with educational standards established by the individual disciplines and recognized by the board. This administrative regulation further provides authorization for students working outside the clinical education setting.
(c) How this administrative regulation conforms to the content of the authorizing statutes:
The regulation is in conformity as the authorizing statute giving the board the ability to promulgate regulations to carry out and enforce the provisions. KRS 311B.080 which requires the board to recognize and enforce national practice standards, scopes of practice, and ethical standards. 311B.050(2) requires the Kentucky Board of Medical Imaging and Radiation Therapy to promulgate administrative regulations to administer and enforce KRS Chapter 311B.
(d) How this administrative regulation currently assists or will assist in the effective administration of the statutes:
This administrative regulation establishes uniform curricula standards for postsecondary educational institutions and further establishes authorization for students working outside their clinical education setting.
(2) If this is an amendment to an existing administrative regulation, provide a brief summary of:
(a) How the amendment will change this existing administrative regulation:
The amendment updates student employment outside the academic clinical setting to authorize those who are licensed in accordance with 201 KAR 46:045 the ability to be employed.
(b) The necessity of the amendment to this administrative regulation:
The amendment is necessary to address other changes in the regulations filed as well as to allow qualified individuals to seek employment opportunities.
(c) How the amendment conforms to the content of the authorizing statutes:
The amendment is in conformity as the authorizing statute gives the board the ability to promulgate regulations to carry out and enforce the provisions. KRS 311B.080 requires the board to recognize and enforce national practice standards, scopes of practice, and ethical standards. 311B.050(2) requires the Kentucky Board of Medical Imaging and Radiation Therapy to promulgate administrative regulations to administer and enforce KRS Chapter 311B.
(d) How the amendment will assist in the effective administration of the statutes:
The amendment will allow additional individuals to be considered for licensing based on qualifications set forth in 201 KAR 46:045.
(3) Does this administrative regulation or amendment implement legislation from the previous five years?
No.
(4) List the type and number of individuals, businesses, organizations, or state and local governments affected by this administrative regulation:
Approximately 300 state health care organizations and approximately 8,000 licensees.
(5) Provide an analysis of how the entities identified in question (4) will be impacted by either the implementation of this administrative regulation, if new, or by the change, if it is an amendment, including:
(a) List the actions that each of the regulated entities identified in question (4) will have to take to comply with this administrative regulation or amendment:
Healthcare Organizations: These organizations will not have to take any action to comply with this amendment, unless the organization chooses to hire temporary student radiographers. If a healthcare organization chooses to hire a temporary student radiographer, they will need to provide proper oversight for the individual(s), as noted in 201 KAR 46:045. Licensees: Only qualified temporary student radiographers seeking a license will be required to comply with this administrative regulation. It will require that a student seeking employment outside the academic clinical setting must apply for and obtain a temporary student radiography license prior to being employed.
(b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (4):
The cost for the licensee would be an application and licensing fee, required by 201 KAR 46:020.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (4):
This regulation will aid healthcare organizations in addressing known workforce shortage in the medical imaging profession, to improve access to healthcare by removing barriers to licensing, which will improve the timeliness with which healthcare organizations will be able to provide medical imaging to Kentuckians. Students will be eligible to apply for a temporary student radiography license, thus being able to seek gainful employment.
(6) Provide an estimate of how much it will cost the administrative body to implement this administrative regulation:
(a) Initially:
No new costs will be incurred by the changes.
(b) On a continuing basis:
No continuing costs will be incurred by the changes.
(7) What is the source of the funding to be used for the implementation and enforcement of this administrative regulation or this amendment:
The board’s operations are funded by fees paid by licensees and applicants.
(8) Provide an assessment of whether an increase in fees or funding will be necessary to implement this administrative regulation, if new, or by the change if it is an amendment:
The amendment does not require an increase in funding. A new fee has been established for the application and licensing of the temporary student radiographer.
(9) State whether or not this administrative regulation establishes any fees or directly or indirectly increases any fees:
The amendment will require the establishment of a new fee to address application and licensing fee for the temporary student radiographer.
(10) TIERING: Is tiering applied?
Tiering was not applied as the regulation is applicable to all radiography students interested in obtaining employment outside of the academic clinical setting. This regulation does not distinguish between similarly situated individuals on the basis of any factor.

(2) State whether this administrative regulation is expressly authorized by an act of the General Assembly, and if so, identify the act:
Although amendment of this administrative regulation is not expressly authorized by an act by the General Assembly, the Board confirms it is necessary to address the disparities within the healthcare workforce, particularly with medical imaging as well as access to healthcare within the Commonwealth. The General Assembly declared that the practice of medical imaging, radiation therapy, and related occupations should be regulated and controlled as provided by KRS 311B and by the administrative regulations of the board in order to protect and safeguard the health and safety of the citizens of the Commonwealth of Kentucky (2012 Ky. Acts ch. 50, sec. 1, effective July 12, 2012).
