Pursuant to KRS 13A.190(1)(a)(2), KRS Chapter 324A, and 2026 Ky. Acts Ch. 172 this emergency administrative regulation is being promulgated to comply with the adoption of 2026 HB 355 which creates the Kentucky Real Property Appraisers Board (the “Board”) and requires the Board to establish by administrative regulation fee amounts for all fees required by KRS Chapter 324A and the fees for services provided by the board, which shall not exceed amounts necessary to generate sufficient funds to effectively carry out and enforce the Chapter. The Board shall establish and collect the following fees: initial application fee, examination fee, a biennial licensure fee, duplicate certificate fee, certificate correction fee, roster fee, returned check fee, prelicensure education course review fee, continuing education course review fee, and other fees as required to provide services.
The effective date of the Act requires that this emergency regulation be promulgated to ensure there is no delay in collecting fees and processing applications upon the effective date and therefore “[p]revent an imminent loss of federal or state funds” pursuant to KRS 13A.190(1)(a)(2). This emergency administrative regulation is temporary in nature and will be replaced by an ordinary administrative regulation as provided by KRS 13A.190. The ordinary regulation will be filed with this emergency regulation and will be identical.

General requirements for certification and licensure.
An appraiser for a federally related transaction shall be a(n):Associate real property appraiser;Licensed residential real property appraiser;Certified residential real property appraiser; orCertified general real property appraiser.The board may license nonfederal real property appraisers pursuant to Section 4 of this administrative regulation.General Requirements for Certification or Licensure. Except as provided by Sections 3 and 4 of this administrative regulation, certification or licensure shall be granted if an applicant:Meets the education requirements established by 201 KAR 050:030;Meets the appraisal experience requirements established by 201 KAR 050:040;Meets the examination requirements established by 201 KAR 050:050;Completes and submits a notarized application form for the type of certification or licensure sought, incorporated by reference in Section 5 of this administrative regulation;Submits to a national fingerprint-supported criminal background check in accordance with 201 KAR 050:080;Pays the fees established in 201 KAR 050:010 Section 1(1)(a) and (b); andFor applications for licensed residential real property appraiser, certified residential real property appraiser, and certified general real property appraiser, pays the roster fee established in 201 KAR 050:010 Section 1(1)(g).Armed Forces and Military Spousal Exception.Applicants for licensure or certification seeking to claim an exception under KRS 12.245, KRS 12.334, KRS 12.354, or KRS 12.357, shall so indicate by marking the appropriate selection box and shall submit supporting documentation.The board shall review an application claiming an exception under KRS 12.245, KRS 12.334, KRS 12.354, or KRS 12.357, within thirty (30) days of receipt by the board.An applicant who was a member of a Reserve component of the U.S. Armed Forces, who was pursuing an appraiser licensure or certification prior to December 1, 2011, and who was called to active duty between December 1, 2011 and December 31, 2014, may satisfy the examination, education, and experience requirements under the 2008 AQB Real Property Appraiser Qualification Criteria instead of the requirements in this administrative regulation for a time period equal to the applicant's time of active duty, plus twelve (12) months.Licensed Nonfederal Real Property Appraisers.An applicant shall be licensed as a nonfederal real property appraiser if:The applicant possesses a:General equivalency diploma; andApplies to the board on the Application for Nonfederal Real Property Appraiser License.A licensed nonfederal real property appraiser shall not be required to meet the conditions established for the:General real property appraisers; orResidential real property appraisers.Licensure of licensed residential real property appraisers.A licensed nonfederal real property appraiser shall not perform real property appraisals of property that is the subject of a federally related transaction.The provisions of this section shall not apply to persons who, prior to April 7, 1992, have engaged in the appraisal of real property for at least ten (10) years.
