STATEMENT OF EMERGENCY
201 KAR 50:110E

Pursuant to KRS 13A.190(1)(a)(2), KRS Chapter 324A, and 2026 Ky. Acts Ch. 172 this emergency administrative regulation is being promulgated to comply with the adoption of 2026 HB 355 which creates the Kentucky Real Property Appraisers Board (the “Board”) and requires the Board to establish by administrative regulation fee amounts for all fees required by KRS Chapter 324A and the fees for services provided by the board, which shall not exceed amounts necessary to generate sufficient funds to effectively carry out and enforce the Chapter. The Board shall establish and collect the following fees: initial application fee, examination fee, a biennial licensure fee, duplicate certificate fee, certificate correction fee, roster fee, returned check fee, prelicensure education course review fee, continuing education course review fee, and other fees as required to provide services.


The effective date of the Act requires that this emergency regulation be promulgated to ensure there is no delay in collecting fees and processing applications upon the effective date and therefore “[p]revent an imminent loss of federal or state funds” pursuant to KRS 13A.190(1)(a)(2). This emergency administrative regulation is temporary in nature and will be replaced by an ordinary administrative regulation as provided by KRS 13A.190. The ordinary regulation will be filed with this emergency regulation and will be identical.

201 KAR 50:110E.Renewal and reinstatement of certificates and licenses.

Section 1.

Certificate and license biennial renewal date and expiration.

(1)

The biennial renewal date shall be July 1 of each odd calendar year.

(2)

A certificate or license issued by the board shall expire if the credential holder fails to comply with Section 2 of this administrative regulation on or before the biennial renewal date.

(3)

Prior to the biennial renewal date, the board shall notify each credential holder that the license or certificate is due to expire. Failure to receive notification shall not excuse the credential holder of the obligation to renew.

Section 2.

How to renew a license or certificate.

(1)

Except as provided in subsection (2) of this section or Section 3 of this regulation, a person seeking to renew a license or certificate issued by the board shall, on or before the biennial renewal date, through the online license renewal system offered by the board at www.krpab.ky.gov:

(a)

Complete and submit the online Application to Renew or Reinstate a Certificate or License;

(b)

Complete the continuing education required by administrative regulation 201 KAR 050:100;

(c)

Pay the biennial certificate or licensure fee established in administrative regulation 201 KAR 050:010 Section 1(1)(d); and

(d)

Unless renewing an associate real property appraiser license, pay the roster fee established in administrative regulation 201 KAR 050:010 Section 1(1)(g).

(2)

If a licensed or certified appraiser is unable to use the online license renewal system, he or she shall, on or before the biennial renewal date:

(a)

Complete and submit to the board an Application to Renew or Reinstate a Certificate or License;

(b)

Complete the continuing education required by administrative regulation 201 KAR 050:100;

(c)

Pay the biennial certificate or licensure fee established in administrative regulation 201 KAR 050:010 Section 1(1)(d); and

(d)

Unless renewing an associate real property appraiser license, submit payment for the roster fee established in administrative regulation 201 KAR 050:010 Section 1(1)(g).

Section 3.

Renewal of nonfederal real property appraiser license. To renew a nonfederal real property appraiser license issued by the board, the nonfederal real property appraiser shall, on or before the biennial renewal date:

(1)

Complete and submit to the board an Application to Renew or Reinstate a Certificate or License; and

(2)

Pay the biennial certificate or licensure fee established in administrative regulation 201 KAR 050:010 Section 1(1)(d).

Section 4.

Reinstatement of expired certificate or license.

(1)

A former credential holder for federally related transactions may apply for reinstatement through January 2 of the calendar year following the year in which a certificate or license expired by:

(a)

Completing and submitting to the board an Application to Renew or Reinstate a Certificate or License;

(b)

Completing the continuing education required by administrative regulation 201 KAR 050:100;

(c)

Paying the biennial certificate or licensure fee established in administrative regulation 201 KAR 050:010 Section 1(1)(d);

(d)

Unless most recently credentialed as an associate real property appraiser, submitting payment for the roster fee established in administrative regulation 201 KAR 050:010 Section 1(1)(g); and

(e)

Paying the late fee established in 201 KAR 3:010 Section 1(1)(l).

(2)

A former licensed nonfederal real property appraiser may apply for reinstatement through January 2 of the calendar year following the year in which a certificate or license expired by:

(a)

Completing and submitting to the board a Nonfederal Real Property Appraiser Application;

(b)

Paying the biennial certificate or licensure fee established in administrative regulation 201 KAR 3:010 Section 1(1)(d); and

(c)

Paying the late fee established in 201 KAR 050:010 Section 1(1)(l).

(3)

If six (6) months or more elapse after a certificate or license expires, the former credential holder shall not be eligible for reinstatement and shall be required to meet all requirements for initial certification or licensure established in 201 KAR 050:020.

(4)

An application for reinstatement under this section shall be presented to the board for review at the first regularly scheduled meeting of the board after an application is received by the board at least five (5) business days before the first regularly scheduled meeting and at the following regularly scheduled meeting if an application is received by the board less than five (5) business days before the first regularly scheduled meeting.

KRS 324A.035(3)(a), (b), and (c) require the board to establish by administrative regulations requirements for classifications of appraisers, certification and licensure, and renewal of certification or licensure. KRS 324A.045(2) requires every certificate and license shall be subject to biennial renewal on the date or dates determined by the board by administrative regulation and that each certificate and license holder provide proof of compliance with the continuing education requirements, or the certificate or license shall expire. KRS 324A.045(3) requires that an expired certificate or license may be reinstated by complying with renewal requirements and payment of a late fee.
(d) How this administrative regulation currently assists or will assist in the effective administration of the statutes:
This administrative regulation describes how to renew certificates and licenses issued by the board and how to apply for reinstatement of a certificate or license previously issued by the board.

This administrative regulation will affect the 1,281 appraisers, 145 associate appraisers, 2 nonfederal appraisers, and the 99 appraisal management companies (“AMCs”) currently licensed by the Board, as well as all new applicants for licensure.
(5) Provide an analysis of how the entities identified in question (4) will be impacted by either the implementation of this administrative regulation, if new, or by the change, if it is an amendment, including:
(a) List the actions that each of the regulated entities identified in question (4) will have to take to comply with this administrative regulation or amendment:
Licensees need to familiarize themselves with the process and process for renewal and reinstatement of credentials.

Licensees seeking renewal and reinstatement will be required to pay the fees associated with renewal and reinstatement.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (4):
Licensees will be granted renewal and reinstatement.

The Kentucky Real Property Appraisers Board was created by H.B. 355, 2026 Ky. Acts ch. 172 (eff. July 15, 2026) and has a provisional budget approved by the Board. This budget includes three employees who will implement and enforce this administrative regulation.
