PUBLIC HEARING AND COMMENT PERIOD: A public hearing on this administrative regulation amendment shall be held Wednesday, October 21, 2026, at 9:00 a.m. ET/10 a.m. CT at the Justice and Public Safety Cabinet, 125 Holmes Street, Frankfort, Kentucky 40601. Individuals interested in being heard at this hearing shall notify this agency in writing by five workdays prior to the hearing of their intent to attend. If no notification of intent to attend the hearing is received by that date, the hearing may be canceled. This hearing is open to the public. Any person who wishes to be heard will be given an opportunity to comment on the proposed administrative regulation. A transcript of the public hearing will not be made unless a written request for a transcript is made. If you do not wish to be heard at the public hearing, you may submit written comments on the proposed administrative regulation. Written comments shall be accepted until October 31, 2026. (a) What this administrative regulation does:
This administrative regulation incorporates by reference into regulatory form materials used by the Department of Juvenile Justice in the implementation of a statewide juvenile services program.
(b) The necessity of this administrative regulation:
This administrative regulation is necessary to provide clear guidance regarding the implementation of statewide juvenile services program.
(c) How this administrative regulation conforms to the content of the authorizing statutes:
KRS 15A.065(1), 15A.0652, 15A.067, 15A.160, 15A.210, 15A.305(5), 605.150, 635.095, 635.100, and 640.120 authorize the Justice and Public Safety Cabinet and the Department of Juvenile Justice to promulgate administrative regulations for the proper administration of the cabinet and its programs. This administrative regulation incorporates by reference into regulatory form materials used by the Department of Juvenile Justice in the implementation of a statewide juvenile services program.
(d) How this administrative regulation currently assists or will assist in the effective administration of the statutes:
This administrative regulation assists in the effective administration of the statewide juvenile services program by providing clear guidance for in the implementation of a statewide juvenile services program.
(2) If this is an amendment to an existing administrative regulation, provide a brief summary of:
(a) How the amendment will change this existing administrative regulation:
This amendment updates material incorporated by reference, specifically, Department of Juvenile Justice, Policy Number DJJ 605 by adding a Graduated Sanctions Grid and Graduated Response Decision Matrix.
(b) The necessity of the amendment to this administrative regulation:
The amendment is needed to comply with KRS 15A.0652(2)(b)1.
(c) How the amendment conforms to the content of the authorizing statutes:
KRS 15A.065(1), 15A.0652, 15A.067, 15A.160, 15A.210, 15A.305(5), 605.150, 635.095, 635.100, and 640.120 authorize the Justice and Public Safety Cabinet and the Department of Juvenile Justice to promulgate administrative regulations for the proper administration of the cabinet and its programs. This administrative regulation incorporates by reference into regulatory form materials used by the Department of Juvenile Justice in the implementation of a statewide juvenile services program.
(d) How the amendment will assist in the effective administration of the statutes:
This administrative regulation assists in the effective administration of the statewide juvenile services program by providing guidance for the administration of the program. More specifically, the amendment incorporates the continuum of sanctions that apply in response to a child’s violation of the terms or conditions of community supervision.
(3) Does this administrative regulation or amendment implement legislation from the previous five years?
No.
(4) List the type and number of individuals, businesses, organizations, or state and local governments affected by this administrative regulation:
This amendment affects the Department of Juvenile Justice, its staff, and between approximately 600 to 1,200 juveniles on community supervision or community supervision, depending on fluctuations in that population.
(5) Provide an analysis of how the entities identified in question (4) will be impacted by either the implementation of this administrative regulation, if new, or by the change, if it is an amendment, including:
(a) List the actions that each of the regulated entities identified in question (4) will have to take to comply with this administrative regulation or amendment:
Department of Juvenile Justice employees and juveniles subject to community supervision will not have to take any additional steps to comply with the amendment as the incorporated materials were already being used when applying sanctions in response to a child’s violation of the terms or conditions of community supervision.
(b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (4):
The Department of Juvenile Justice will not need additional staff, funding, equipment, or information technology systems to implement this amendment. There will be no additional cost to juveniles subject to community supervision.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (4):
As a result of compliance, Department of Juvenile Justice staff and juveniles subject to community supervision will have a clearer understanding of the continuum of sanctions that apply in response to a child’s violation of the terms or conditions of community supervision.
(6) Provide an estimate of how much it will cost the administrative body to implement this administrative regulation:
(a) Initially:
No additional cost is anticipated. The Department of Juvenile Justice will implement this amendment using existing staff, existing resources, and existing systems.
(b) On a continuing basis:
No additional continuing cost is anticipated. The Department of Juvenile Justice will implement this amendment using existing staff, existing resources, and existing systems.
(7) What is the source of the funding to be used for the implementation and enforcement of this administrative regulation or this amendment:

Rather, the amendment provides guidance to Department of Juvenile Justice staff and juveniles subject to community supervision related to the continuum of sanctions that apply in response to a child’s violation of the terms or conditions of community supervision.
