780 KAR 2:110.Student medical and accident insurance.

Section 1.

Definition. "Kentucky TECH" means the system of state-operated secondary career and technical education programs in the area technology centers.

Section 2.

Students enrolled in a Kentucky TECH school, except for students enrolled in continuing education or customized business and industry classes, shall have medical and accident insurance coverage during the period of enrollment.

Section 3.

The policy entered into between the executive director and a surety, insurance company, or one (1) of their agents shall:

(1)

Be a full excess policy; and

(2)

Pay the covered expenses incurred which are in excess of those paid or payable by another plan.

Section 4.

The medical and accident coverage shall consist of a single contract applied to the plan of coverage contained in the contract between the Commonwealth and the carrier.

Section 5.

Following an authorized signature by an official of the insuring company, the insurance policy shall:

(1)

Be attached to the contract; and

(2)

Become a part of the medical and accident insurance contract.

Section 6.

Coverage shall:

(1)

Take effect on the date requested; and

(2)

Remain in effect through the expiration date shown on the application.

Section 7.

(1)

The Office of Career and Technical Education shall authorize payment of the premium to:

(a)

A surety;

(b)

An insurance company; or

(c)

An agent thereof.

(2)

The premium shall be based on the average number of students that were enrolled:

(a)

During the previous quarter; and

(b)

In Kentucky TECH schools.

Section 8.

This administrative regulation shall not be construed as a waiver of the sovereign immunity of the Commonwealth.
