815 KAR 15:080.Boiler and pressure vessel licenses.

Section 1.

Boiler and Pressure Vessel Contractors.

(1)

The boiler and pressure vessel contractor licenses are offered in the following classes, with the scope of work permitted in each class accordingly:

(a)

Class A license: Unlimited scope.

(b)

Class B license: Low pressure steam boilers and piping, hot water heating boilers and piping, hot water supply boilers, pool heaters, hot water storage tanks, pressure vessels up to 200 psi that do not contain steam or anhydrous ammonia.

(c)

Class C license: Pressure vessels only. Limited to cryogenic bulk tanks, CO2 beverage tanks, compressed air receivers 200 psi or less and piping, and jacketed steam cooking kettles.

(2)

Examinations.

(a)

All examination applicants shall submit to the department:

1.

A completed Boiler and Pressure Vessel Contractor Examination Registration Form, Form PLB-BPV-5.

2.

A non-refundable examination fee, as follows:

a.

Class A license: $150

b.

Class B license: $100

c.

Class C license: $50

3.

A passport size facial photograph of the applicant, taken within the past six (6) months; and

4.

Proof that the applicant is eighteen (18) years of age or older.

(b)

All examinations shall cover the following topics:

1.

KRS Chapter 236;

2.

815 KAR Chapter 15; and

3.

National Board Inspection Code, Part I.

(c)

Examination Schedule.

1.

Regular examination of applicants for a boiler contractor license shall be conducted once a month.

2.

Other examination dates may be conducted as the department directs.

3.

The department shall give notice to the examinees of the date, time, and place of the examination at least one (1) week prior to the date of the examination.

(d)

Passing Score. To pass a Class A, B, or C examination, the examinee shall have a score of at least seventy percent (70%). A passing score shall be valid for three (3) years.

(e)

Examination retakes. An applicant may retake the examination at any scheduled date. An applicant shall pay the full fee for an examination retake.

(f)

The Class A, B, and C examination requirements in this regulation shall not apply to those boiler and pressure vessel contractors who are already licensed as boiler and pressure vessel contractors, as of the date that this regulatory revision becomes effective.

(3)

Boiler Contractor License Application

(a)

An applicant for a boiler contractor license shall submit to the department the following:

1.

A completed boiler contractor license application, form PLB BPV-1;

2.

A passport size facial photograph of the applicant, taken within the past six (6) months;

3.

Proof that the applicant is eighteen (18) years of age or older;

4.

Proof that the applicant passed the related examination for the class of license applied for;

5.

A non-refundable license fee for the class applied for:

a.

Class A license: $250

b.

Class B license: $200

c.

Class C license: $100

(b)

If the initial license is for a period of less than twelve (12) months, the initial license fee shall be reduced on a pro rata basis. The initial license fee shall not be prorated for fewer than seven (7) months.

(4)

Termination of application. The initial application shall remain pending until all of the requirements are met or for a period of up to twelve (12) contiguous months after the date the application is submitted to the department. If the application requirements are not met after twelve (12) contiguous months, the application shall be void.

(5)

License Renewal.

(a)

A boiler and pressure vessel contractor license shall expire annually on the last day of the licensee's birth months unless renewed in accordance with this subsection.

(b)

An applicant for the renewal of a boiler and pressure vessel contractor license shall submit to the department on or before the expiration of the license:

1.

A completed Boiler and Pressure Vessel Contractor License Application Form PLB BPV-1, and

2.

A non-refundable annual renewal fee for the class of license renewed, payable to the Kentucky State Treasurer.

a.

Class A license: $250

b.

Class B license: $200

c.

Class C license: $100

(6)

Representation.

(a)

A boiler and pressure vessel contractor shall only represent one (1) company or individual at a time, unless he or she owns at least twenty-five (25) percent of each business entity.

(b)

A company or individual principal may engage in the business of installing, erecting, or repairing boilers, pressure vessels, or pressure piping within the Commonwealth if either one person connected with such a company or an individual principal responsible for the boiler, pressure vessel, or pressure piping work is a boiler and pressure vessel contractor. The boiler and pressure vessel contractor is responsible for the work done by the company.

(c)

If a boiler and pressure vessel contractor is responsible for the boiler, pressure vessel, or pressure piping work for a company or individual engaged in the boiler, pressure vessel, or pressure piping business, then he or she shall notify the department at any time that he or she commences or severs his or her connection with the company or individual.

(1)

Application. An applicant for an initial boiler and pressure vessel contractor license shall submit to the department:

(a)

Proof that the applicant is eighteen (18) years of age or older;

(b)

A completed Boiler and Pressure Vessel Contractor License Application on Form PLB-BPV-1;

(c)

A passport-sized color photograph of the applicant taken within the past six (6) months; and

(d)

A nonrefundable license fee of $250 payable to the Kentucky State Treasurer. If an initial license is for a period of less than twelve (12) months, the initial license fee shall be reduced on a pro rata basis. The initial license fee shall not be prorated for less than seven (7) months.

(2)

Examination.

(a)

An applicant for a boiler and pressure vessel contractor license shall take and pass the examination required by KRS 236.210 before an initial license may be issued under this section.

(b)

The applicant shall successfully complete the examination with a passing score of at least seventy (70) percent.

(c)

A passing score on the examination shall be valid for a period of three (3) years.

(3)

Termination of an application.

(a)

The initial application shall remain pending until all requirements are met or for a period of up to one (1) year after the date the application is submitted to the department.

(b)

At the end of one (1) year, the application shall be void.

(4)

License Renewal.

(a)

A boiler and pressure vessel contractor license shall expire annually on the last day of the licensee's birth month unless renewed in accordance with this subsection.

(b)

An applicant for renewal of a boiler and pressure vessel contractor license shall submit to the department on or before the expiration of the license:

1.

A completed Boiler and Pressure Vessel Contractor License Application on Form PLB-BPV-1; and

2.

A nonrefundable annual renewal fee of $175 payable to the Kentucky State Treasurer.

(5)

Representation.

(a)

A boiler or pressure vessel contractor shall provide general supervision to and be primarily responsible for all work performed by the licensee's employees.

(b)

A company or individual may engage in the business of installing, erecting, or repairing boilers, pressure vessels, or pressure piping within the Commonwealth if one person connected with such a company or individual responsible for the boiler, pressure vessel, or pressure piping work is a boiler and pressure vessel contractor.

(c)

Any boiler and pressure vessel contractor, responsible for the boiler, pressure vessel, or pressure piping work for a company or individual engaged in the boiler, pressure vessel, or pressure piping business, shall notify the department at any time he commences or severs his connection with the company or individual.

(d)

A boiler and pressure vessel contractor shall only represent one (1) company or individual at a time.

Section 2.

Owner Facilities.

(1)

Application. An applicant for an owner facility license shall submit to the department:

(a)

A completed Owner Facility License Application on Form PLB-BPV-2;

(b)

The fee required by KRS 236.097(1)(d), payable to the Kentucky State Treasurer;

(c)

Proof of employee or contractor who holds a license pursuant to KRS 236.210; and

(d)

Proof that the facility has general liability insurance through a company permitted to transact insurance in Kentucky.

(2)

License Renewal.

(a)

An owner facility license shall expire after a period of two (2) years, on the last day of the month in which the license was initially issued, unless renewed in accordance with this subsection.

(b)

An applicant for renewal of an owner facility license issued in accordance with this section shall, by no later than sixty (60) days prior to the expiration of the license, submit to the department:

1.

A completed Owner Facility License Application on Form PLB-BPV-2; and

2.

The fee required by KRS 236.097(1)(f), payable to the Kentucky State Treasurer.

(3)

Inspection prohibition. An owner facility shall not conduct, or allow to be conducted, any piping inspections under the owner facility's license unless the inspector performing the inspection is licensed pursuant to Section 3 or Section 4 of this administrative regulation.

Section 3.

Owner's Piping Inspectors.

(1)

Application. An applicant for an initial owner's piping inspector license shall submit to the department:

(a)

Proof that the applicant is eighteen (18) years of age or older;

(b)

A completed Owner's Piping Inspector License Application on Form PLB-BPV-3;

(c)

A passport-sized color photograph of the applicant taken within the past six (6) months;

(d)

Proof that the applicant is a United States citizen or authorized to work in the United States; and

(e)(d)

The nonrefundable fee required by KRS 236.097(2)(c), payable to the Kentucky State Treasurer. If an initial license is for a period of less than twenty-four (24) months, the initial license fee shall be prorated in accordance with KRS 236.097(2)(d).

(2)

License renewal.

(a)

An owner's piping inspector license shall expire on the last day of the licensee's birth month in the second year following the issue date.

(b)

An applicant for renewal of an owner's piping inspector license shall, on or before the expiration of the license, submit to the department:

1.

A completed Owner's Piping Inspector License Application on Form PLB-BPV-3; and

2.

The fee required by KRS 236.097(2)(f), payable to the Kentucky State Treasurer.

Section 4.

Independent Inspection Agencies.

(1)

Application. An applicant for an initial independent inspection agency license shall submit to the department:

(a)

A completed Independent Inspection Agency License Application on Form PLB-BPV-4; and

(b)

The fee required by KRS 236.097(3)(b), payable to the Kentucky State Treasurer.

(2)

License renewal.

(a)

An independent inspection agency license shall expire after a period of two (2) years, on the last day of the month in which the license was initially issued.

(b)

An applicant for renewal of an independent inspection agency license shall, on or before the expiration of the license, submit to the department:

1.

A completed Independent Inspection Agency License Application on Form PLB-BPV-4; and

2.

The fee required by KRS 236.097(3)(e), payable to the Kentucky State Treasurer.

This administrative regulation establishes the fees, standards, and forms incident to the licensing of boiler and pressure vessel contractors, owner facilities, owner’s piping inspectors, and independent inspection agencies.

This administrative regulation is necessary to establish the application and fee requirements for applicants for a boiler and pressure vessel contractor license, an owner facilities license, owner’s piping inspector license, and an independent inspection agency license.

KRS 236.030 requires the commissioner to promulgate administrative regulations that establish reasonable standards for the safe construction, installation, inspection, and repair of boilers, pressure vessels, and associated pressure piping in Kentucky. KRS 236.097 establishes criteria and fees for the issuance of owner facility, owner’s piping inspector, and independent inspection agency licenses, and authorizes the department to develop the applications required for the issuance and renewal of these licenses. KRS 236.210 requires the commissioner to promulgate administrative regulation for reasonable fees for a boiler and pressure vessel license.
(d) How this administrative regulation currently assists or will assist in the effective administration of the statutes:
This administrative regulation establishes the statutorily mandated application and fee requirements for applicants for a boiler and pressure vessel contractor license, an owner facilities license, owner’s piping inspector license, and an independent inspection agency license.

(a) How the amendment will change this existing administrative regulation:
This regulatory amendment establishes Class A, B, and C boiler and pressure vessel contractor licenses, along with appropriate examination requirements. The amendment also establishes appropriate licensing fees and renewal procedures. The amendment establishes representation restrictions on contractors.
(b) The necessity of the amendment to this administrative regulation:
The practical realities of boiler and pressure vessel work require tiered licensing to more fairly represent those levels. Multi-class licensing more fairly represents the contractors’ scope of work and technical knowledge.
(c) How the amendment conforms to the content of the authorizing statutes:
This amendment helps establish the fees, standards, and forms incident to the licensing of boiler and pressure vessel contractors, owner facilities, owner’s piping inspectors, and independent inspection agencies.
(d) How the amendment will assist in the effective administration of the statutes:
This amendment makes the administrative regulation easier to understand and establishes appropriate boiler and pressure vessel contractor types to ensure public safety.

(a) List the actions that each of the regulated entities identified in question (4) will have to take to comply with this administrative regulation or amendment:
Currently licensed boiler and pressure vessel contractors will be grandfathered in under this regulation and will simply need to continue renewing their licenses yearly and paying the appropriate licensure fees. Applicants for a boiler and pressure vessel contractor license will need to take an examination and otherwise fulfill the application requirements.
(b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (4):
Applicants for Class A licenses shall pay a $250 initial license and renewal fee. Applicants for Class B licenses shall pay a $200 initial license and renewal fee. Applicants for Class C licenses shall pay a $100 initial license and renewal fee. Candidates for examination shall pay $150 to take the Class A examination, $100 to take the Class B examination, and $50 to take the Class C examination.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (4):
All individuals in the boiler and pressure vessel industry will gain the benefits of well-qualified and appropriately certified boiler and pressure vessel contractors. This will increase workplace safety and the safety of the public at large.
(6) Provide an estimate of how much it will cost the administrative body to implement this administrative regulation:
(a) Initially:
There are no anticipated initial costs to administer this regulatory amendment.
(b) On a continuing basis:
There are no anticipated continuing costs to administer this regulatory amendment.
(7) What is the source of the funding to be used for the implementation and enforcement of this administrative regulation or this amendment:
Any department costs of implementation will be met with existing department funds.

Yes, this regulation establishes fees.

Yes, this regulation establishes fees for examination, licensure, and re- licensure.
(10) TIERING: Is tiering applied?
Yes, tiering is applied. Class A licensees pay the most for their examinations and licenses, because they are the most qualified and will have the ability to perform all boiler and pressure vessel contracting. Class B licensees pay middle tier fees, because they will have the ability to perform contracting services on middle-tier boilers and pressure vessels. Finally, Class C licensees pay the least in fees, because they will only be allowed to perform contracting services on pressure vessels.
