STATEMENT OF EMERGENCY
902 KAR 2:250E
This emergency administrative regulation is being promulgated to establish the storage and handling protocols for the COVID-19 vaccines. All health care providers who provide the COVID-19 vaccine will need to ensure the vaccine is stored in compliance with the storage and handling protocols established by the Centers for Disease Control and Prevention. This emergency administrative regulation is needed pursuant to KRS 13A.190(1)(a)1. to protect public health, safety, and welfare, and KRS 13A.190(1)(a)3. as directed by 2021 Extra. Sess. Ky. Acts Ch. 5. This emergency administrative regulation will not be replaced by an ordinary administrative regulation.

Section 1.
Vaccine Storage Protocol.(1)
All COVID-19 vaccines shall be stored in accordance with the most current guidance from the Centers for Disease Control and Prevention available online at https://www.cdc.gov/vaccines/hcp/admin/storage/toolkit/index.html.(2)
The Janssen (Johnson and Johnson) COVID-19 vaccine shall be stored in accordance with the most current protocol established by the Centers for Disease Control and Prevention (CDC) available at https://www.cdc.gov/vaccines/covid-19/info-by-product/janssen/downloads/janssen-storage-handling-summary.pdf.(3)
The Moderna COVID-19 vaccine shall be stored in accordance with the most current protocol established by the CDC available at https://www.cdc.gov/vaccines/covid-19/info-by-product/moderna/downloads/storage-summary.pdf.(4)

PUBLIC HEARING AND COMMENT PERIOD: A public hearing on this administrative regulation shall, if requested, be held on November 22, 2021, at 9:00 a.m. using the CHFS Office of Legislative and Regulatory Affairs Zoom meeting room. The Zoom invitation will be emailed to each requestor the week prior to the scheduled hearing. Individuals interested in attending this virtual hearing shall notify this agency in writing by November 15, 2021, five (5) workdays prior to the hearing, of their intent to attend. If no notification of intent to attend the hearing is received by that date, the hearing may be canceled. This hearing is open to the public. Any person who attends virtually will be given an opportunity to comment on the proposed administrative regulation. A transcript of the public hearing will not be made unless a written request for a transcript is made. If you do not wish to be heard at the public hearing, you may submit written comments on this proposed administrative regulation until November 30, 2021. Send written notification of intent to attend the public hearing or written comments on the proposed administrative regulation to the contact person. Pursuant to KRS 13A.280(8), copies of the statement of consideration and, if applicable, the amended after comments version of the administrative regulation shall be made available upon request.

This new emergency administrative regulation references the COVID-19 vaccine storage and handling summaries issued by the Centers for Disease Control and Prevention (CDC).
(b) The necessity of this administrative regulation:
This emergency administrative regulation is necessary to ensure the proper storage and handling of the COVID-19 vaccines.
(c) How this administrative regulation conforms to the content of the authorizing statutes:
2021 Extra. Sess. Ky. Acts Ch. 5 requires the cabinet to promulgate an emergency administrative regulation related to the storage of the COVID-19 vaccine.
(d) How this administrative regulation currently assists or will assist in the effective administration of the statutes:
This emergency administrative regulation will ensure the available COVID-19 vaccines are stored and handled in accordance with the guidance issued from the CDC.
(2) If this is an amendment to an existing administrative regulation, provide a brief summary of:
(a) How the amendment will change this existing administrative regulation:
This is a new administrative regulation.
(b) The necessity of the amendment to this administrative regulation:
This is a new administrative regulation.

This new emergency administrative regulation will impact all health care providers who register with the cabinet to administer a COVID-19 vaccine.
(4) Provide an analysis of how the entities identified in question (3) will be impacted by either the implementation of this administrative regulation, if new, or by the change, if it is an amendment, including:
(a) List the actions that each of the regulated entities identified in question (3) will have to take to comply with this administrative regulation or amendment:
All health care providers offering a COVID-19 vaccine will need to ensure they are able to properly store and handle the vaccine, regardless of the vaccine being provided.
(b) In complying with this administrative regulation or amendment, how much will it cost each of the entities identified in question (3):
The cost is unknown. Many health care providers have sufficient facilities and equipment for the safe storage and handling of vaccines. Those that do not currently have the required facilities and equipment would incur the costs associated with procuring these.
(c) As a result of compliance, what benefits will accrue to the entities identified in question (3):
Health care providers will be able to offer a COVID-19 vaccination as part of the routine care provided to patients. This will help to increase the total number of citizens who are vaccinated against COVID-19.
(5) Provide an estimate of how much it will cost the administrative body to implement this administrative regulation:
(a) Initially:
This new emergency administrative regulation will have no impact on the budget of the cabinet. The vaccine storage and handling protocols have been developed by the CDC and are available to the public on the CDC website.
(b) On a continuing basis:
This new emergency administrative regulation will not impact the budget of the cabinet on an ongoing basis.
(6) What is the source of the funding to be used for the implementation and enforcement of this administrative regulation:
The funding necessary to implement this emergency administrative regulation will be from state general fund dollars.
(7) Provide an assessment of whether an increase in fees or funding will be necessary to implement this administrative regulation, if new, or by the change if it is an amendment:
An increase in fees or funding is not necessary to implement this new emergency administrative regulation.

Tiering is not applied. Health care providers will need to follow the storage and handling protocols for the vaccine they choose to provide.

This new emergency administrative regulation will impact the Division of Epidemiology and Health Planning in the Department for Public Health as well as all local health departments providing a COVID-19 vaccination.
