Summary Retain original provisions; create a new section of KRS 218A to allow a practitioner to prohibit substitution when the practitioner determines that substitution is not in the best interest of the patient; exempt drugs prescribed or dispensed for patients in a nursing home or hospice care setting; prohibit substitution or interchange of those drugs without the pharmacy verifying that the substitute provides substantially similar tamper-resistance properties as determined by the board or without obtaining written consent of the prescriber; require the Kentucky Board of Pharmacy to publish and, in some cases, determine qualifying drugs for a list of opioid analgesics that incorporate tamper-resistance technologies; exempt from compliance pharmacists in hospital-based pharmacies filling prescriptions for inpatient care; name Section 3 of this bill the STOPP in Kentucky Act of 2013; and to establish that the provisions of Section 3 of this bill will expire upon the adoption of national standards related to tamper-resistant technology for drugs by the United States Food and Drug Administration.
