Summary of Original Version Create a new section of KRS Chapter 150 to define "adjacent landowner" and "commission-managed lands"; waive the sovereign immunity of the Department of Fish and Wildlife Resources and establish the department's liability when the operations of commission-managed lands results in damages to property of an adjacent landowner; provide that a claim for damages shall be brought in the county in which the adjacent landowner's property is located, and the action shall not be removed to Franklin Circuit or District Court; provide that the Kentucky Claims Commission does not have jurisdiction over an adjacent landowner's claim for damages.
