Summary of Original Version | Amend KRS 304.17A-500 to define terms; create a new section of KRS 304.17A-500 to 304.17A-590 to define "covered health care services"; require health benefit plans to provide coverage and reimburse for covered health care services provided by a nonparticipating health care provider at an in-network facility; prohibit nonparticipating health care providers from attempting to collect payment from a covered person for covered health care services other than applicable cost-sharing; amend KRS 304.17A-580 to add provisions of KRS 304.17A-641 and require insurers to reimburse a nonparticipating provider for the provision of emergency medical conditions and emergency department screening and stabilization services at an in-network facility; amend KRS 304.17A-254 and KRS 304.17A-527 to provide requirements for contracts between insurers and providers who are health facilities; amend KRS 304.17A-565 to provide that the provisions of KRS 304.17A-500 to KRS 304.17A-590 shall not be construed to preempt or supersede other rights or remedies available to covered persons under law; amend KRS 18A.225 to require the state employee health plan to comply with Sections 2, 3, 4, 6; amend KRS 304.17B-001 and KRS 304.17A-649 to conform; repeal KRS 304.17A-640 and 304.17A-641; EFFECTIVE January 1, 2021. |
