Summary | Retain original provisions; amend KRS 177.912 to require any auto recycler to comply with all local ordinances, rules, and regulations, regardless if the auto recycler is required to be permitted under KRS 177.910; specifies that for any auto recycler required to be permitted under KRS 177.910, the commissioner of highways may exempt the auto recycler from the permit process, if the local government certifies the auto recycler's compliance as a conforming use in an industrially zoned area under the applicable zoning ordinances and regulations. |

Summary | Allow recyclers permitted by the department on the effective date of the Act, but no longer subject to department oversight to continue operation on the same site for which they were permitted; keep screening, site, and use restrictions imposed by the department in place unless removed by a planning and zoning body, city, or county; give responsibility for enforcement at the local level to county attorneys. |
