Summary of Original Version Amend KRS 304.17A-005 to define "emergency medical condition" and amend definition of "telehealth"; create a new section of Subtitle 17A of KRS Chapter 304 to define terms; require health benefit plan insurers to develop and implement a program that provides incentives for covered persons who elect to receive a comparable health care service; require health benefit plan insurers to establish an interactive mechanism for covered persons to obtain certain information about the cost and quality, if available, of nonemergency health care services; require coverage for certain nonemergency health care services provided by a nonparticipating provider; require compliance with certain federal regulations; amend KRS 304.17A-254 and 304.17A-527 to require insurers to file a description of the incentive program with the Department of Insurance; require that insurance contracts with participating providers include clauses that require the providers to make certain disclosures; amend KRS 304.17A-505 to require certain disclosures to covered persons; create a new section of KRS Chapter 367 to require nonparticipating providers to make certain price disclosures to covered persons upon request; require that certain notifications be posted by the provider; amend KRS 304.17A-096, 304.17A-500, 304.17A-550, 304.17A-580, 304.17A-649, 304.17B-001, 304.17B-015, 304.17B-033, 304.17C-010, 304.38A-010, 304.39-241, and 304.17A-0954 to conform; repeal KRS 304.17A-640; provide that provisions are severable; EFFECTIVE January 1, 2022.
