Summary of Original Version Amend KRS 620.040 to require law enforcement to request a blood, breath, or urine test from a caregiver suspected of being under the influence at the time of a child fatality or near fatality, and to request a search warrant for the test if consent is not given by the caregiver; amend KRS 620.055 to change the number of members on the external child fatality and near fatality review panel from 15 to 17, to include the President of the Kentucky Coroners Association and a medication-assisted treatment provider selected by the Attorney General; require membership of the co-chairs of the Child Welfare Oversight and Advisory Committee instead of the chairs of the House and Senate Health and Welfare Committees; require the panel's annual report to be due February 1 of each year instead of December 1 of each year; create a process for the panel to suggest recommendations to state agencies and for the state agencies to respond and implement the recommendations; establish that all proceedings, opinions, and records of the panel are privileged and not subject to subpoena.

Summary Retain original provisions; make change to the membership of the external child fatality and near fatality review panel to include two members of the Kentucky General Assembly, one appointed by the President of the Senate, and one appointed by the Speaker of the House, instead of the chairpersons of Senate and House Health and Welfare Committees; specify parent as a person officers shall request drug test from when there are reasonable grounds to request one; amend KRS 72.410 to require a coroner to immediately contact Department for Community Based Services, law enforcement, and local health department to determine the existence of relevant information concerning the case, instead of as soon as practicable.
