Summary of Original Version Create a new section of KRS Chapter 160 to require a school district or public charter school to adopt a written policy on information that the district provides about former school personnel when responding to a request for information from a potential employer that is a school or school district; establish the minimum contents of the policy; provide that allegations of sexual misconduct involving a minor or a student shall not be deemed to be known or supported by probable cause if certain conditions set forth in federal law are met; create civil immunity for good-faith reports of information to potential employers that comply with the school or school district; waive civil immunity and create liability for a school district or public charter school that fails to disclose the sexual misconduct of a former employee when certain conditions are met; provide that nothing in the section shall be interpreted to impair or eliminate mandatory reporting under KRS 620.030; amend KRS 160.380 to require a superintendent to terminate an employee convicted of a criminal offense against a victim who is a minor; require schools to request information on a potential employee from a previous employer that is a Kentucky public school; require a school employee to disclose any conviction of a criminal offense against a victim who is a minor.
