Summary of Original Version Create a new section of KRS Chapter 417 to prevent an employer from having a defense to a claim that an arbitration agreement is unconscionable if the employee alleges claims of sexual harassment and was not fully informed of the inclusion of the arbitration agreement or its impact at the time that the employment agreement was entered into, or if the inclusion of an arbitration provision in the agreement was a condition of employment; prohibit a court from enforcing or compelling arbitration if it finds that a provision of an agreement is unconscionable; limit their restrictions to judicial proceedings initiated on or after the effective date of this Act.
