401 KAR 63:060.List of hazardous air pollutants, petitions process, lesser quantity designations, and source category list.
Section 1.
Definitions. As used in this administrative regulation, terms not defined in this section shall have the meaning given to them in 40 C.F.R. 63.2.(1)
"Hazardous air pollutant" means a substance listed in Section 2 of this administrative regulation.(2)
"MACT" means maximum achievable control technology.(3)
"Major source" means any stationary source or group of stationary sources located within a contiguous area and under common control that emits or has the potential to emit considering controls, in the aggregate, ten (10) tons per year or more of a hazardous air pollutant or twenty-five (25) tons per year or more of any combination of hazardous air pollutants, or a lesser quantity which the cabinet may establish on the basis of the potency, persistence, potential for bioaccumulation, or other characteristics or relevant factors pertaining to the pollutant.(4)
"NESHAP" means national emission standards for hazardous air pollutant.Section 2.
