502 KAR 40:020.Agreements for the legal exchange of criminal justice information.

Section 1.

Criminal Justice Information Exchange Agreements Where the Kentucky State Police is Designated as the User Agency. The Commissioner of the Department of State Police may at the discretion of the commissioner, enter into agreements with federal, state, local or any other agency or entity as he deems fit, for the purpose of having receiving and/or submitting criminal justice information to criminal justice information systems as covered in the respective agreement. Further, pursuant to mandates as designated in the respective criminal justice agreements, the commissioner shall insure that all provisions listed in said agreements are followed by the Department of State Police or any and all criminal justice agencies within the Commonwealth having access to that respective criminal justice information system.

Section 2.

Criminal Justice Information Exchange Agreements Whereby the Department of State Police is Designated as the System Control Agency. The commissioner shall develop and institute Criminal Justice Information Exchange Agreements with criminal justice terminal agencies within the Commonwealth prior to the exchange of any criminal justice information.
