Summary of Original Version Create new sections of KRS Chapter 281A, relating to commercial driver's licenses, to require employers of persons possessing a commercial driver's license to report results of positive drug and alcohol screening tests to the Transportation Cabinet within three business days of receiving the results; establish the same requirements for a medical review officer acting on behalf of a Kentucky motor carrier; require the Transportation Cabinet to establish a commercial driver drug and alcohol testing database; establish procedures for requesting and receiving reports from the database; establish penalties for failure to check applicants against the database or failure to report positive drug or alcohol screening tests; amend KRS 281A.010 to define "medical review officer"; amend KRS 281A.220 to establish that applicants and employees applying for a safety sensitive transportation job who possess a commercial driver's license are deemed to have given consent to testing; amend KRS 281.755 to conform; EFFECTIVE January 1, 2010.
