Summary of Original Version Create a new section of Subchapter 70 of KRS Chapter 224 to require the Energy and Environment cabinet to maintain a list of impaired water identified pursuant to 33.U.S.C.sec. 1313(d) and total maximum daily load effluent limitations; identify the methods, information and rationale for placing the water on the list of impaired waters or the development of a new TMDL; provide notice to those who want to be alerted to waters on the 303(d) list or new total maximum daily load limitations; require the cabinet to take all necessary step to remove restrictions or limitations as a result of a listing or a new TMDL if the water later meets applicable water quality standards; require the cabinet to report the following year's TMDL development plan and make the written report available to the Interim Joint Committee on Natural Resources and Environment and place it on the cabinet's Web site.
