Summary of Original Version | Create a new section of KRS Chapter 218A to mandate priority access for pregnant women to substance abuse treatment or recovery service programs, prevent discrimination against pregnant women by substance abuse treatment or recovery service providers, and provide practitioners civil immunity for failing to recognize controlled substance abuse by a pregnant patient or referring a pregnant patient to substance abuse treatment or recovery services consistent with community standards of care; amend KRS 625.050 to prevent the filing of a petition to terminate the parental rights of a pregnant woman who used a controlled substance during pregnancy if she, by the twentieth week of pregnancy, enrolls in and maintains compliance with both a substance abuse treatment or recovery program and prenatal care throughout the remaining term of that pregnancy. |
