Amendment Free Conference Committee Report 1
Summary Delete all provisions; amend 2022 RS HB 5/GA, Section 4, 2022 Ky. Acts ch. 2, sec. 4, to allow a qualified lender to be eligible to receive certain financial support; require that eligible expenses be limited to the extent of damage directly caused by the storms; include within eligible expenses costs associated with contracted employees to administer and report on the funds; allow nonprofit or public utility service providers to received moneys in the fund and require that the funds shall not be used for capital improvements; allow moneys reimbursed to the Commonwealth before July 1, 2024, to be deposited in the SAFE fund and require moneys reimbursed after June 30, 2024, to be deposited in the general fund; require the Office of State Budget Director to report on the lists of requests and amounts awarded to the Senate Standing Committee on Appropriations and Revenue and the House Standing Committee on Appropriations and Revenue or the Interim Joint Committee on Appropriations and Revenue; require the Department of Education to report on the lists of requests and amounts awarded to the Senate Standing Committee on Appropriations and Revenue and the House Standing Committee on Appropriations and Revenue or the Interim Joint Committee on Appropriations and Revenue; require the Cabinet for Economic Development to report quarterly on the amounts distributed to qualified lenders for loss payments to the Senate Standing Committee on Appropriations and Revenue and the House Standing Committee on Appropriations and Revenue or the Interim Joint Committee on Appropriations and Revenue; create a new section of Subchapter 20 of KRS Chapter 154 to define terms; create a new section of Subchapter 20 of KRS Chapter 154 to establish a process for qualified lenders to make loans to an eligible company; create a new section of Subchapter 20 of KRS Chapter 154 to require an eligible company to apply for all other available assistance, notify the qualified lender of other assistance, and provide an update on the status of the assistance; create a new section of Subchapter 20 of KRS Chapter 154 to create the Western Kentucky Risk Assistance fund; appropriate $25,000,000 from the West Kentucky State Aid Funding for Emergencies Fund to the Western Kentucky Risk Assistance fund; allow a public agency that is located within the areas named in a Presidential Declaration of Emergency relating to the storms and tornadoes that occurred in December 2021 to be exempted from the public procurement procedures required by state law if the public agency makes any decision related to the selection of vendors within an open meeting and any contract entered into is made part of the public record and is subject to disclosure; appropriate $120,890,000 from the West Kentucky State Aid Funding for Emergencies Fund to the Department of Military Affairs budget unit; appropriate $100,000 from the General Fund to the Department for Local Government to be distributed to the Paducah City Commission; appropriate $110,000 from the West Kentucky State Aid Funding for Emergencies Fund to Murray State University; EMERGENCY; APPROPRIATION; amend the title.
