| Summary of Enacted Version | Amends KRS 508.130 to define "social media platform" and modify existing definitions; establish elements of the crime of stalking and penalize as a Class D felony unless certain aggravating circumstances are met, in which case it is a Class C felony; amends KRS 511.010 to define "employee", "employer", "threatening behavior", and "workplace"; amends KRS 511.070 to expand the elements of criminal trespass in the second degree to include knowingly entering or remaining in a workplace while engaging in threatening behavior where notice against trespass is given; establish that a second or subsequent criminal trespass in the second degree offense within 3 years is a Class A misdemeanor; amends KRS 511.080 to establish that a second or subsequent criminal trespass in the third degree offense within 3 years is a Class B misdemeanor; amends various statutes to conform; repeals KRS 508.140 and 508.150, relating to stalking in the first and second degrees; and provides that the Act shall not affect the validity of restraining orders on the basis of domestic violence and abuse or dating abuse, interpersonal protective orders, or domestic violence orders in place prior to the effective date of the Act. |
