| Summary of Enacted Version | Amends KRS 189A.010 to prohibit operation of a motor vehicle while clonazepam, cyclobenzaprine, or fentanyl are detected in the blood; remove refusal of a blood test as an aggravating circumstance; amends KRS 189A.100 to provide that a person's refusal to take a preliminary breath test shall not result in the suspension of the person's license; require law enforcement to inform the person suspected of driving under the influence of the fact that his or her refusal to take a preliminary breath test shall not be used against him or her in court or result in the suspension of his or her license; amends KRS 189A.105 to provide that at the time a blood test is requested, the person suspected of driving under the influence shall be informed that the fact of a refusal to submit to the blood test shall not be used against him or her in court as evidence of driving under the influence but will result in suspension of his or her driver's license, and if the person is convicted of a violation of KRS 189A.010, his or her license will be suspended; provide that if a law enforcement officer does not inform a person suspected of driving under the influence of his or her rights relating to blood or breath tests, a refusal to take a blood or breath test shall not be used against that person; and amends KRS 186.018 to require the Transportation Cabinet to destroy records of moving traffic convictions that are more than 10 years old. |

| Summary | Amend KRS 235.240 to require that when a motorboat or vessel causes an accident that results in a fatality or serious physical injury, the investigating law enforcement officer shall seek a search warrant for blood testing of the operator of the motorboat or vessel unless the test has already been done by consent; amend KRS 235.990 to conform; create a new section of KRS Chapter 15 to require a public safety telecommunicator who receives a report of an accident involving a motorboat or vessel on any waters of the Commonwealth to report the accident to the Kentucky State Police post covering where the accident occurred; provide that Sections 5 to 7 of the Act may be cited as Keegan's Law. |
