Summary of Original Version | Create a new section of KRS Chapter 216 to provide for the certification of personal services agencies; define the terms "cabinet", "client", "department", "personal services", "personal services agency", "parent personal services agency", and "secretary"; require a personal services agency to be certified; require existing personal services agencies to file an application for certification by December 31, 2009, and other agencies to obtain certification prior to providing personal services; require the secretary of the Cabinet for Health and Family Services to promulgate administrative regulations; provide that only personal services agencies meeting standards for certification will be granted a certificate; require all fees to be paid to the State Treasury and used for funding a department as specified by the secretary of the Cabinet for Health and Family Services; impose a fine of $500 per day for a personal services agency that provides services without proper certification; impose a fine of $500 per day on a business that markets its services as a personal services agency without proper certification; create a new section of KRS Chapter 45 to create the Kentucky personal services agency fund and establish the parameters of the fund; require moneys in the fund to be used by a department as specified by the secretary of the Cabinet for Health and Family Services for administrative purposes; provide that moneys remaining in the fund at the end of the fiscal year will carry forward into the succeeding fiscal year; provide that interest earned on moneys in the fund will accrue to the account; and provide that moneys are appropriated for purposes set forth in the Act. |
