Summary of Original Version | Amend KRS 278.021 to define circumstances that constitute abandonment of a gas, water, electric, or sewer service public utility; provide for control and responsibility for abandoned utilities placed in receivership to remain with the court-appointed receiver until the Franklin Circuit Court, after hearing, orders the receiver to return control to the utility or to liquidate the assets; provide that the Public Service Commission may, without holding a hearing, petition the Franklin Circuit Court for temporary receivership of an abandoned utility under certain circumstances; provide that an order granting temporary receivership shall expire sixty days after entry if the commission does not, after notice and hearing, bring an action seeking permanent receivership; create a new section of KRS Chapter 278 to require that any gas, water, electric, or sewer utility service that receives a notice of discontinuance or termination of service from one or more of its suppliers that will prevent the provision of service to its customers, notify the commission in writing within one (1) business day of receipt of the notice. |
